Individuals injured in a collision whom Amica Mutual Insurance Co. paid the policy limit for uninsured or underinsured motorist coverage on one vehicle but the policy also covered one or more other vehicles may qualify to receive a payment from a class action settlement.

Amica Mutual Insurance Co. agreed to pay $2.88 million to settle a class action lawsuit alleging it failed to pay the full amount of uninsured or underinsured motorist benefits required by Arizona law when it insured multiple vehicles under the same policy. The plaintiff claimed Amica did not provide the necessary policy language and notice that would have allowed policyholders to "stack" coverage for each vehicle, potentially increasing their total recovery after a covered accident.

Who are the class members?

Class members must meet the following criteria:

  • An Amica Mutual Insurance Co. policy issued in Arizona insured them.
  • Their policy included uninsured or underinsured motorist coverage for more than one vehicle.
  • They received the limit of liability for uninsured or underinsured motorist benefits for only one vehicle between Oct. 18, 2016, and July 15, 2024.
  • They received a notice in the mail about the settlement.

How much is the Amica insurance settlement payment?

Pro rata cash payment: Eligible class members will receive a pro rata cash payment from the net settlement fund. The settlement administrator will determine the payment amount by the number of valid claims and the policy limits involved for each class member.

Class members do not need to file a claim to receive a settlement payment.

The $2,875,000 settlement fund will include:

  • Settlement administration costs: Up to $15,300
  • Attorneys’ fees: Up to $862,500

  • Payments to eligible class members: Remaining settlement funds

When is the Amica Mutual Insurance settlement payout date?

The settlement administrator will mail payments to eligible class members approximately 90 days after court grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Amica did not pay the full amount of uninsured or underinsured motorist benefits to policyholders with multiple vehicles on their policies. Under Arizona law, unless an insurance company includes specific policy language and provides written notice, policyholders may be entitled to “stack” coverage for each insured vehicle.

The plaintiff claimed Amica failed to provide the required policy language and notice, which would have allowed insureds to recover higher amounts. Amica denied the allegations but agreed to settle to avoid the expense and risk of further litigation.
