People who received a notice stating the January 2024 Avfuel data breach may have compromised their private information could qualify to submit a claim for up to $5,000 from a class action settlement.

Avfuel Corp. agreed to settle a class action lawsuit stemming from a targeted cyberattack on its computer systems in January 2024. The lawsuit alleges a threat actor accessed files containing personal information, including names and Social Security numbers, during the breach.

Who can file a data breach claim?

Class members are individuals residing in the United States who received a notice from Avfuel Corp. stating the January 2024 data incident may have impacted their private information.

How much is the class action settlement payment?

Class members can claim one or more of these benefits:

  • Out-of-pocket expenses: Class members can submit a claim to receive up to $2,500 for actual, documented expenses incurred as a result of the data incident. This includes fees for credit reports, credit monitoring, freezing or unfreezing credit, replacing IDs or postage.
  • Losses for identity theft or fraud: Claimants who lost money due to identity theft or fraud traceable to the data breach can claim up to $5,000 in documented losses. Monetary losses must be traceable to the incident and not already covered by other reimbursements.
  • Cash payment for lost time: Class members can submit a claim for lost time spent dealing with the data incident at $25 per hour for up to six hours for a maximum of $150. This includes time spent changing passwords, investigating suspicious activity or researching the incident.
  • Alternative cash payment: Class members who do not submit a claim for out-of-pocket expenses, identity theft or fraud losses, or lost time can claim a one-time $50 cash payment.
  • Credit monitoring services: All class members can elect to receive two years of credit monitoring services.

How to claim a data breach class action rebate

Class members must file a claim online or print and complete a PDF claim form to mail or email to the settlement administrator. The claim deadline is Nov. 4, 2025.

Required proof and claim information

  • Online claims require the notice ID and PIN from the class member's settlement notice.
  • Out-of-pocket expenses claims require supporting documentation, such as receipts, invoices or bank and credit card statements showing fees and unreimbursed charges.
  • Identity theft or fraud claims require proof, such as police reports, bank or credit card statements showing fraudulent charges or invoices for accountant or attorney services.

Data breach settlement fund

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees and costs: Up to $350,000
  • Service awards to class representatives: $3,000 each ($6,000 total)
  • Credit monitoring services: Cost determined by number of claims filed
  • Payments to approved claimants: Total determined by number of submitted claims

When is the Avfuel data breach settlement payout date?

The settlement administrator will issue payments and credit monitoring codes to eligible claimants approximately 60 days after the court grants final approval of the settlement.

The class action lawsuit alleged a targeted cyberattack on Avfuel’s computer systems in January 2024 compromised files containing private current and former employee information.
