Who is eligible for a Aven Financial class action payout?

Class members must meet the following criteria:

  • They reside in the United States at the time of the data breach (on or around July 17, 2023).
  • Their personal information was impacted by the data breach.
  • They received a notice from Aven Financial Inc. informing them of the incident.

There are two categories of class members:

  • General settlement class: All U.S. residents whose information was affected and who received notice from Aven.
  • California settlement subclass: Members of the general settlement class who had a California address on file at the time of the breach.

How much is the data breach payout?

  • Alternative cash payment: Class members who do not have out-of-pocket expenses can opt for a pro rata cash payment. The exact amount will depend on the number of valid claims submitted.
  • Out-of-pocket expenses: Up to $1,000 for documented, unreimbursed expenses related to the data breach.
  • Lost time: Up to $240 for time spent remedying identity theft or credit inaccuracies caused by the breach. Compensation is calculated at $40 per hour for up to six hours ($360 total).
  • California statutory award: California residents at the time of the breach may claim an additional pro rata cash payment of up to $75.
  • Credit monitoring and identity theft protection: All class members can receive three years of credit monitoring and identity theft protection services. This includes alerts from all three major credit bureaus and up to $1 million in identity theft insurance.

How to claim a Sysco class action rebate

Class members can file a claim online or download, print and complete the PDF claim form to mail to the settlement administrator. The claim deadline is Sept. 11, 2025.

Proof and documentation required

  • Claimants must provide their Claim ID, which is located in the top right corner of the notice that was emailed to them by the settlement administrator. Those who did not receive a notice but believe they are a settlement class member should contact the settlement administrator.
  • Out-of-pocket expenses: Class members must provide supporting documents, such as receipts, bank statements or bills. Eligible out-of-pocket expenses include:
    • Bank fees (such as card replacement or over-limit fees)
    • Interest on short-term loans
    • Postage or travel costs
    • Costs for credit reports, credit freezes, or credit monitoring purchased after the breach

$450,000 data breach settlement fund breakdown

The $450,000 settlement fund includes:

  • Settlement administration costs: Up to $56,112
  • Attorneys' fees and costs: Up to $112,500
  • Service awards for class representatives: $2,500 each ($7,500 total)
  • Credit monitoring costs: To be determined
  • Payments to eligible class members: The remainder of the fund

When is the Lasky v. Aven Financial Inc. payout date?

Payments will be distributed approximately 90 days after the court grants final approval of the settlement and any appeals are resolved.
