
Nonexempt employees who worked for Oxford Hotels and Resorts LLC d/b/a The Godfrey Hotel Hollywood in California between Nov. 10, 2018, and July 20, 2025, may be eligible to receive a cash payment from a class action settlement.
Oxford Hotels and Resorts LLC agreed to pay $675,000 to settle a class action lawsuit claiming it committed California labor laws violations, including unpaid overtime, missed meal and rest breaks, unreimbursed business expenses and inaccurate wage statements. The settlement also covers claims for restitution under California Business and Professions Code section 17200 and civil penalties under the California Private Attorneys General Act.
Who are the class members?
There are two groups of eligible individuals:
- All current and former nonexempt employees who worked for Oxford Hotels and Resorts LLC in California at any time during the class period (Nov. 10, 2018, to July 20, 2025)
- All current and former nonexempt employees who worked for Oxford Hotels and Resorts LLC in California at any time during the PAGA period (Nov. 10, 2021, to July 20, 2025) (referred to as aggrieved employees)
An individual must have worked at least one day as a nonexempt employee for Oxford in California during the relevant period. The settlement administrator identified class members based on Oxford’s employment records.
How much can class members get?
The total settlement fund is $675,000. After deductions for attorneys’ fees and costs, settlement administration costs, service awards and PAGA penalties, the settlement administrator will distribute the remaining amount to class members and aggrieved employees.
The amount each class member receives depends on:
- The number of workweeks they worked during the class period (for the class settlement portion)
- The number of pay periods they worked during the PAGA period (for the PAGA portion)
Each class member’s number of workweeks (for the class settlement) and pay periods (for the PAGA portion) is listed on the settlement notice they received. If a class member disagrees with the number of workweeks or pay periods credited to them, they can submit a challenge with supporting documentation.
How will the settlement administrator calculate payments?
- Individual class payments: The settlement administrator will divide the net settlement amount by the total number of workweeks all participating class members worked. It then calculates each class member’s payment by multiplying this per-workweek amount by their own number of workweeks.
- Individual PAGA payments: The settlement administrator will divide $7,500 (which is 25% of the $30,000 PAGA penalties) by the total number of PAGA pay periods all aggrieved employees worked. It then calculates each aggrieved employee’s payment by multiplying this per-pay-period amount by their own number of pay periods.
No action needed to receive payment
Class members do not need to file a claim to receive payment. The settlement administrator will automatically send payments by mail to the address on file. Those who moved should notify the administrator to ensure they receive payment.
Class members who wish to opt out of the class settlement (and not receive a class payment) must send a written, signed request for exclusion to the settlement administrator by July 31, 2026. Those who opt out will still receive a PAGA payment if they are an aggrieved employee.
Class members who wish to challenge the number of workweeks or pay periods credited to them must submit supporting documentation, such as pay stubs, by July 31, 2026.

Payout options
The settlement administrator will mail checks to the address on file. Class members can request a replacement check if they lose it and do not cash it before the void date. The administrator will send uncashed checks after the void date to the California controller's unclaimed property fund.
$675,000 settlement fund breakdown
The $675,000 settlement fund covers:
- Settlement administration costs: Up to $17,500
- Attorneys’ fees: Up to $225,000
- Attorneys’ expenses: Up to $32,000
- Service award to the class representative: Up to $7,500
- PAGA penalties: $30,000 ($22,500 to the California Labor and Workforce Development Agency and $7,500 to aggrieved employees)
- Payments to eligible class members: The remainder of the fund
Important dates
- Deadline to opt out or challenge credited workweeks/pay periods: July 31, 2026
- Final approval hearing: Sept. 2, 2026
When is the Luis Borquez v. Oxford Hotels and Resorts LLC payout date?
If the court grants final approval to the settlement, Oxford will fund the settlement within 28 days after the judgment becomes final. The administrator will mail payments within 14 days after receiving the funds.
Why is there a class action settlement?
The class action settlement claimed Oxford Hotels and Resorts LLC failed to comply with California labor laws. The lawsuit alleged unpaid overtime and minimum wages, missed meal and rest breaks, unreimbursed business expenses and inaccurate wage statements.
Oxford denies any wrongdoing but agreed to settle to avoid the expense and uncertainty of continued litigation.
