How much are settlement payments?

  • Reimbursement for documented ordinary out-of-pocket expenses: Class members can claim up to $425 for documented expenses related to the data breach that occurred between April 3, 2024, and Aug. 18, 2026. Eligible expenses include costs for credit reports, credit monitoring, freezing or unfreezing credit, replacing IDs and postage to contact financial institutions.
  • Reimbursement for documented extraordinary out-of-pocket expenses (fraud or identity theft): Class members can claim up to $4,250 for losses due to identity theft or fraud related to the data breach. Claimants must show the breach most likely caused the loss, it is not already covered by ordinary out-of-pocket expenses and that they tried to prevent or recover the monetary loss.
  • Reimbursement for lost time: Class members can claim up to four hours of time spent dealing with the data breach at $23 per hour for a maximum of $92. This includes time spent changing passwords, investigating suspicious account activity and researching the data breach.
  • Alternative cash payment: Class members who do not submit a claim for ordinary out-of-pocket expenses, extraordinary out-of-pocket expenses or lost time can submit a claim to receive a one-time cash payment of $50.
  • Credit monitoring: All class members can elect to receive three years of CyEx Identity Defense Complete, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring.
