Ameriflight $425,000 Pilot Training Repayment Settlement

Pilots who worked for Ameriflight under a training repayment agreement may be eligible to claim reimbursement for training payments and additional compensation from a class action settlement.

Ameriflight LLC agreed to pay $425,000 to settle a class action lawsuit alleging its training repayment agreements included unlawful penalty provisions and resulted in minimum wage violations.

Who are the class members?

The settlement covers two primary groups of pilots. Some individuals may be members of both groups if they meet both sets of criteria.

  • Opt-in plaintiffs: These are individuals who consented to join the Fair Labor Standards Act collective during the opt-in period. This group does not include individuals who received the opportunity to join the collective but did not or whom the plaintiff’s counsel no longer represents.
  • Unlawful penalty class: These are pilots who had a Beechcraft 99 training repayment agreement between Jan. 30, 2019, and Feb. 28, 2025, completed training and left Ameriflight before the end of the repayment plan term. Pilots with repayment agreements for aircraft other than the Beechcraft 99 are not included.

How much can class members receive?

The total settlement fund is $425,000. The amount each class member receives depends on their individual circumstances and which group they belong to. There are two main types of monetary relief under the settlement:

  • Reimbursement for training payments: Class members who made payments to Ameriflight or a third-party debt collector after leaving the company under a training repayment agreement will receive a reimbursement equal to the total amount paid. This includes any interest and collection costs. The reimbursement is considered nontaxable, but class members should consult a tax advisor for personal tax implications.
  • Minimum wage damages: Opt-in plaintiffs will receive a second payment as compensation for alleged minimum wage violations. The settlement administrator will allocate this amount proportionally based on each plaintiff’s total regular earnings while employed by Ameriflight (calculated as regular hours multiplied by wage rate). The administrator will split this payment 50% as wages and 50% as liquidated damages/1099 other income.

No action needed to receive compensation

Class members do not need to file a claim to receive compensation. The settlement administrator will automatically send payments via paper check to the address on file. However, those who prefer to receive payment via Venmo, PayPal or Zelle, can select an alternative payment method online.

The $425,000 settlement fund covers:

  • Settlement administration costs: Up to $10,000
  • Attorneys’ fees: Up to $170,000
  • Attorneys' litigation costs: Up to $45,000
  • Service award to named plaintiff: $10,000
  • Net settlement fund for class members: At least $190,000

When is the Fredericks v. Ameriflight payout date?

The settlement administrator will issue payments to opt-in plaintiffs and unlawful penalty class members for full reimbursement of post-employment training repayments within 30 days after the court resolves any appeals and grants final approval to the settlement.

The settlement administrator will issue payments to opt-in plaintiffs for their minimum wage damages within 120 days after the court resolves any appeals and grants final approval to the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Ameriflight’s training repayment agreements included unlawful penalty provisions and resulted in minimum wage violations. Specifically, the agreements required pilots to make payments after leaving Ameriflight, which the plaintiffs claimed violated federal and state wage laws.

As part of the settlement, Ameriflight agreed to declare these agreements null and void, discontinue collections,and pay monetary relief to affected pilots. Additionally, Ameriflight will waive approximately $852,128 in outstanding balances and will not enforce noncompetition provisions in certain contracts.
