Consumers whose private information a Texas Medical Liability Trust data incident potentially exposed may qualify to claim up to $35,000 from a class action settlement.

Texas Medical Liability Trust has agreed to pay $1,000,000 to settle a class action lawsuit alleging the company failed to adequately safeguard private information, resulting in a data incident that may have exposed sensitive data, such as names, Social Security numbers, tax identification numbers and dates of birth.

Who can file a claim?

Class members include:

  • Anyone in the United States whose private information the data incident involving Texas Medical Liability Trust may have exposed
  • Individuals whom Texas Medical Liability Trust notified that the incident may have exposed their private information

How much can class members get?

  • Ordinary out-of-pocket losses and ordinary attested time: Up to $2,500 per person for documented, unreimbursed costs or time spent ($30 per hour up to five hours for $150 total) responding to the data incident. Examples include costs for credit monitoring, notary fees, postage or freezing/unfreezing credit reports.
  • Extraordinary losses and extraordinary attested time: Up to $35,000 per person for documented, unreimbursed costs or time spent (at $30 per hour up to ten hours for $300 total) remedying identity theft, fraud or misuse of information directly related to the data incident. Examples include losses from identity theft, falsified tax returns or banking fraud.
  • Credit monitoring services: All class members, regardless of whether they submit a claim for reimbursement, can enroll in three years of three-bureau identity theft protection and credit monitoring at no cost. This includes dark web scanning, identity theft insurance, real-time credit monitoring with Equifax, Experian and TransUnion, and access to fraud resolution agents.

If the total amount of approved claims, settlement administration costs, attorneys’ fees and service awards exceeds the $1,000,000 settlement fund, the settlement administrator will reduce each claim proportionally. Conversely, if the total is less than $1,000,000, the settlement administrator will increase claims proportionally.

How to claim a settlement payment

Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Oct. 21, 2025.

Proof or documentation required to submit a claim

  • All class members must provide the class member ID located on their settlement notice.
  • To claim reimbursement for out-of-pocket or extraordinary losses, class members must provide receipts, bills or other documentation that shows the unreimbursed cost, loss or expenditure. Documentation cannot be self-prepared.
  • For time spent, class members must provide an attestation describing the actions they took and the time spent responding to or remedying the data incident.

When is the Texas Medical Liability Trust data incident settlement payout date?

The settlement administrator will distribute payments and credit monitoring services approximately 105 days after the court grants final approval and resolves any appeals.

Why did this class action settlement happen?

The class action lawsuit alleged Texas Medical Liability Trust failed to adequately protect private information, resulting in a data incident discovered on Oct. 12, 2022. Unauthorized actors may have accessed or acquired files containing sensitive information.

The company denies any wrongdoing but agreed to settle to avoid the costs and risks of continued litigation.
