
Consumers who received a mailed notice from Toshiba America Business Solutions informing them their personal information was affected by a data breach in December 2023 may be eligible to submit a claim for up to $7,500, and an additional $150 for California residents, from a class action settlement.
Toshiba America Business Solutions agreed to pay $435,000 to settle a class action lawsuit. The lawsuit alleges TABS failed to adequately protect the personal information of current and former employees, resulting in a data breach where cybercriminals accessed names and Social Security numbers.
Who is eligible for a data breach payout?
Class members must meet the following criteria:
- Toshiba America Business Solutions mailed them a notice stating their personal information was impacted in the Dec. 4, 2023, data incident.
- They are a current or former employee whose name and Social Security number were accessed during the breach.
There are two groups of class members:
- Settlement class members: Anyone who received a notice from TABS stating their personal information was impacted in the data incident.
- California settlement subclass members: Anyone who was mailed notice of the data incident at a California address.
How much is the class action settlement payment?
Class members can select from these benefit options:
- Documented out-of-pocket expense reimbursement: Class members can claim up to $7,500 for documented, unreimbursed monetary losses that are more than likely traceable to the data breach. Any claimed loss must have occurred between Dec. 4, 2023, and Aug.14, 2025, and the claimant must have made reasonable efforts to avoid or seek reimbursement for the loss.
- California settlement subclass payment: California residents who received notice at a California address can claim a flat $150 cash payment.
- Pro rata cash payment: After all valid claims for out-of-pocket expenses and California payments are paid, any remaining funds in the net settlement fund will be issued pro rata to settlement class members who submit valid claims. The payment amount will be determined by the number of approved claims.
How to claim a data breach class action rebate
To claim a settlement payment, class members must submit a claim form. They can file a claim online or print the PDF claim form to mail to the settlement administrator.
Claims must be submitted online or postmarked by Aug. 14, 2025.

Required information and proof
- Class member ID and Pin from settlement notice required to submit a claim online or by mail.
- Out-of-pocket expense reimbursement claims require supporting documentation showing monetary losses were more likely than not caused by the data incident. Required proof includes receipts, bills for services such as identity theft protection and other proof of unreimbursed charges or losses due to fraud.

The settlement fund of $435,000 will include:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $145,000
- Attorneys' costs and litigation expenses: To be presented to the court for approval at a later date
- Service award to the lead plaintiff: $5,000
- Payments to approved claimants: Remaining settlement funds

When is the TABS data breach class action payout date?
Payments will be issued to class members with valid claims 90 days after the court grants final approval of the settlement or within 30 of claim approval, whichever is later.
Why was there a class action lawsuit and settlement?
The class action lawsuit was filed after a data breach on Dec. 4, 2023, in which cybercriminals accessed the personal information of Toshiba America Business Solutions current and former employees. The plaintiffs claimed that TABS failed to adequately protect their information.
TABS denies all allegations but agreed to settle to avoid the expense and risk of continuing litigation. As part of the settlement, TABS will also implement additional security measures.
