Individuals who purchased electronic tickets to Splish Splash waterpark from its official website between Aug. 29, 2022, and March 5, 2024, and paid a processing fee may be eligible to submit a claim for a cash payment from a class action settlement.
Festival Fun Parks LLC, doing business as Palace Entertainment, agreed to pay $1,000,000 to settle a class action lawsuit. The plaintiff claimed the company failed to properly disclose processing fees for electronic ticket purchases at Splish Splash waterpark in violation of New York law.
Who can file a ticket fee claim?
Class members are individuals located in the United States who purchased one or more electronic tickets to Splish Splash waterpark from the official website (www.splishsplash.com) between Aug. 29, 2022, and March 5, 2024, and paid a processing fee in connection with the ticket purchase.
How much are settlement payments?
Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment. The settlement administrator will determine the payment amount by the amount of processing fees paid and total number of claims filed.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or print, complete and mail the PDF claim form to the settlement administrator.

When is the Splish Splash ticket fee settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit claimed Festival Fun Parks LLC, doing business as Palace Entertainment, failed to properly disclose processing fees for electronic ticket purchases at Splish Splash waterpark before customers selected the tickets for purchase. The plaintiff alleged this violated New York Arts and Cultural Affairs Law § 25.07(4).
The defendant denied the allegations but agreed to settle the case to avoid the risk and expense of further litigation.
