
Employees who worked for Speedway in Illinois and scanned their finger on a time clock between Sept. 1, 2012, and Nov. 1, 2017, may qualify to claim an estimated $970 from a class action settlement.
Speedway LLC agreed to pay $12,122,775 to resolve a class action lawsuit alleging it collected employees’ biometric data without providing proper notice or obtaining written consent as required by Illinois law.
Who is eligible for a Speedway payout?
Class members must meet he following criteria:
- They worked for Speedway in Illinois.
- They used a finger scanner on a time clock while employed by Speedway.
- The finger scan occurred between Sept. 1, 2012, and Nov. 1, 2017.
Individuals who received a notice by email or mail are included in the settlement. However, those who did not receive a notice but believe they meet the criteria may contact the settlement administrator at 844-496-0738 or info@SpeedwayBIPASettlement.com to confirm their status.
How much can class members receive?
Each eligible class member is expected to receive a payment of approximately $970. This estimate is based on the total settlement fund minus deductions for attorneys’ fees, litigation expenses, the class representative’s incentive award and settlement administration costs.
The final payment amount may vary depending on the actual number of eligible class members and the final amounts approved for fees and costs.
If the class size exceeds 7,697 individuals, Speedway will pay $1,575 per person in excess of that amount.
If any checks are not cashed within 120 days, and the total value of uncashed checks exceeds $74,000, the settlement administrator will distribute a second round of pro rata payments to class members who cashed their first check. If the total is less than $74,000, or if funds remain after a second round, it will distribute the remainder to a court-approved nonprofit organization (cy pres recipient).
No action necessary to receive payment
Class members do not need to file a claim to receive your payment. The settlement administrator will mail checks automatically to their last known address after the court grants final approval and resolves any appeals.

When is the Speedway BIPA settlement payout date?
The settlement administrator will mail payments approximately 45 days after the court grants final approval and resolves any appeals.
Why did this class action settlement happen?
The class action lawsuit alleged Speedway collected employees’ biometric information through a finger-scanning time clock system without first providing notice or obtaining consent. The plaintiff claimed this violated the Illinois Biometric Information Privacy Act, which requires companies to provide notice and obtain written consent before collecting biometric data.
Speedway denied any wrongdoing or liability but agreed to settle to avoid the risks and costs of further litigation.
