The cybersecurity incident impacted approximately 20,866 Current and former customers and employees.
Saratoga Harness Racing Inc. has agreed to pay to settle a class action lawsuit for alleged failures related to a targeted cyberattack that resulted in unauthorized access to files containing sensitive personal information belonging to current and former customers and employees, which included names, Social Security numbers and driver’s license or state identification numbers. The plaintiffs claimed that the company did not adequately protect private information.
Who can file a claim for a data breach payout?
Class members are individuals residing in the United States who had their private information potentially impacted in the November 2024 Saratoga Harness Racing data breach and/or received notice about the incident.
How much will the settlement payment be?
Class members have the following benefit options:
- Credit monitoring: All class members can elect to receive one year of three-bureau credit monitoring, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning, public records monitoring and access to fraud resolution agents if suspicious activity is detected.
- Cash payment A – Out-of-pocket documented losses: Class members can claim up to $2,500 in documented out-of-pocket losses traceable to the data breach that occurred between Nov. 1, 2024, and May 11, 2026. This includes monetary losses from identity theft or fraud, fees for credit reports or freezing/unfreezing credit, costs to replace IDs and postage to contact banks. Expenses that have already been reimbursed by a third party are not eligible.
- Cash payment B – Alternate cash: Class members that do not submit an out-of-pocket documented losses claim can submit to receive a one-time $50 cash payment.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online, or print the PDF claim form to complete and mail it to the settlement administrator.
