Nonexempt hourly employees who worked for Nature’s Path Foods USA Inc. in Washington state between March 31, 2022, and March 31, 2026, may be eligible to receive a cash payment from a class action settlement.
Nature’s Path Foods USA Inc. agreed to pay $1.395 million to resolve a lawsuit alleging it failed to properly compensate employees for missed and noncompliant meal and rest periods in violation of Washington state law.
Who are the class members?
The class includes all current and former nonexempt (hourly) employees of Nature’s Path Foods USA Inc. who worked in the state of Washington at any time between March 31, 2022, and March 31, 2026.
How much can class members get?
The total settlement fund is $1,395,000. After deductions for attorneys’ fees, litigation costs, the class representative’s service award and settlement administration expenses, the settlement administrator will distribute the remaining amount to class members.
Each class member’s payment is based on their share of total W-2 wages earned during the class period compared to the total earnings of all class members. The more they earned as an hourly employee during the class period, the larger their share of the settlement.
The settlement administrator will split each payment as 40% wages (reported on a W-2) and 60% damages, penalties and interest (reported on a 1099).
No claim form required
Class members do not need to file a claim to receive payment. Eligible class members who do not opt out will automatically receive a check after the court approves the settlement.
