Consumers whose private information the May 2024 data breach at Regional Obstetrical Consultants P.C. potentially compromised may be eligible to claim up to $7,500 from a class action settlement.

Regional Obstetrical Consultants P.C. agreed to resolve a class action lawsuit alleging a data incident led to unauthorized access to sensitive personal and medical information.

Who can file a claim?

The settlement class includes all living individuals in the United States whose private information the data breach that occurred on or about May 6, 2024, potentially compromised.

The types of private information affected may include:

  • Names
  • Dates of birth
  • Addresses and phone numbers
  • Medical record numbers
  • Insurance ID numbers
  • Diagnoses, medical history and procedures
  • Any other personally identifiable information or protected health information

How much can class members get?

Class members can submit a claim for one of three types of cash payments, depending on the nature and documentation of their losses:

  • Cash Payment A – Extraordinary documented losses: Up to $7,500 for actual, documented and unreimbursed monetary losses related to identity theft and traceable to the data breach. To qualify, the claimant must show:
    • The loss occurred between May 6, 2024, and Feb. 15, 2026.
    • The loss is not already covered by other reimbursement categories.
    • They made reasonable efforts to avoid or recover the loss, including using available credit monitoring or identity theft insurance.
  • Cash Payment B – Ordinary documented losses: Up to $2,000 for ordinary losses, such as unreimbursed expenses related to identity theft, credit report access or freezing, notary, fax, postage, copying, mileage or other mitigative costs. Documentation, such as receipts or third-party correspondence, is required.
  • Cash Payment C – Alternate cash payment: If the claimant does not have documentation or does not qualify for the above, they can claim a flat $50 payment without providing documentation.

How to claim a settlement payout

Class members can file the online claim form or download, print and complete the PDF claim form (Page 50 of the settlement agreement) and mail it to the settlement administrator. They may also request a paper claim form by calling 1-877-450-8783 or writing to the settlement administrator at the address below.

What information is necessary to submit a claim?

  • All claimants must provide the unique ID printed on the postcard notice they received in the mail. Online claimants must also provide the PIN from the same notice. Those who did not receive a notice or lost theirs should contact the settlement administrator at at 1-877-450-8783 for assistance.
  • For Cash Payment A (extraordinary documented losses) and Cash Payment B (ordinary documented losses), claimants must provide third-party documentation, such as receipts, correspondence or other records supporting their claim. Personal statements alone are not sufficient, but class members may include them for clarification.
  • For Cash Payment C (alternate cash payment of $50), no documentation is required.

The settlement administrator will review all claims and supporting documents to determine eligibility and payment amounts.

Settlement fund breakdown

The settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Up to $275,000
  • Service awards for class representatives: Up to $2,000 each
  • Payments to eligible class members: Not dependent on the above payments

  • Final approval/fairness hearing: March 2, 2026

When is the Davis v. Regional Obstetrical payout date?

The settlement administrator will distribute settlement payments to valid claimants no later April 16, 2026.

Why did this class action settlement happen?

The class action alleged a data breach occurred on or about May 6, 2024, that allowed unauthorized parties to access or acquire private information from Regional Obstetrical Consultants P.C. The plaintiffs claimed the company failed to adequately protect sensitive information.

The defendant denies any wrongdoing or legal liability. Both sides agreed to settle to avoid the risks and costs of ongoing litigation.
