
Individuals who received a notice from Pediatric Home Respiratory Services, doing business as Pediatric Home Service, stating their private and protected health information was impacted in the November 2024 data breach, may be eligible to submit a claim for up to $1,500 from a class action settlement. The cybersecurity incident compromised PII and PHI belonging to 43,6434 individuals.
Pediatric Home Respiratory Services LLC has agreed to pay to settle a class action lawsuit. The plaintiffs claimed the company failed to adequately protect personal and medical information during a targeted cyberattack in November 2024.
Who can file a data breach claim?
- Class members are all individuals living in the United States who were sent notice by Pediatric Home Respiratory Services LLC, d/b/a Pediatric Home Service, that their personal and health information was impacted in the November 2024 data breach.
- Parents or guardians of minors who received notice may file a claim on behalf of the minor
How much is the settlement payout?
Class members can claim one credit monitoring benefit and one cash payment benefit.
Cash payment benefit options:
- Cash payment A – Documented losses: Class members can claim up to $1,500 for documented out-of-pocket losses traceable to the data incident. This includes monetary losses from identity theft or fraud, fees for credit reports, credit monitoring, freezing or unfreezing credit, costs to replace IDs and postage for contacting banks. Only losses incurred between Nov. 1, 2024, and April 23, 2026, are eligible.
- Cash payment B – Alternate cash: Class members that do not submit a documented losses claim can submit to receive a one-time payment of $50.
Credit monitoring payment benefit options:
- CyEx Medical Shield Complete: This credit monitoring option is available for adults and includes $1 million medical identity theft insurance and monitoring for healthcare insurance ID exposure, medical record number exposure, and unauthorized HSA spending.
- CyEx Identity Defense Total: This credit monitoring option is for adults and includes $1 million identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring.
- CyEx Minor Defense Pro: This credit monitoring option is for minors and includes identity monitoring, public records tracing and dark web monitoring.
How to claim a class action rebate
To claim a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

When is the Pediatric Home Service data breach settlement payout date?
Payments and credit monitoring codes will be issued to approved claimants approximately 90 days after the court grants final approval of the settlement.
Why did this class action settlement happen?
The class action lawsuit was filed after a targeted cyberattack on Pediatric Home Service’s computer systems in November 2024. Plaintiffs alleged the company failed to adequately protect private and protected health information, including names, addresses, Social Security numbers, medical and health insurance details.
Pediatric Home denied the allegations but agreed to settle to avoid the expense and risk of continued litigation.
