Individuals who purchased generic duloxetine manufactured for Breckenridge Pharmaceutical Inc. between Aug. 4, 2020, and May 22, 2025, may be eligible to submit a claim to receive A single payment of up to $7.50 or $10 per prescription from a class action settlement.

Breckenridge Pharmaceutical Inc. has agreed to resolve a lawsuit alleging that its generic duloxetine contained an impurity called n-nitroso-duloxetine (NDLX), a nitrosamine that may be harmful under certain circumstances. The lawsuit claims that the presence of NDLX made the product unlawful to sell and economically worthless, resulting in financial losses for consumers.

The settlement provides compensation for economic losses only and does not address personal injury claims.

Who can file a claim for a duloxetine payment?

Class members are individuals in the United States who purchased Breckenridge duloxetine for personal or household use between Aug. 4, 2020, and May 22, 2025. The settlement includes both recalled duloxetine and non-recalled duloxetine. A list of recalled products with expiration dates, NDC and lot numbers is located on the settlement website.

Who is excluded from the class?

Individuals who did not pay out-of-pocket for Breckenridge duloxetine does not qualify to participate in the settlement. For example, if insurance covered the entire cost or if the prescription was provided at no charge.

How much is the class action settlement payout?

Class members may claim only one of the following:

  • Non-recall tier: Class members who purchased one or more Breckenridge duloxetine prescriptions between Aug. 4, 2020, and May 22, 2025, that were not subject to a product recall can submit to receive a single payment of $5, regardless of the number of prescriptions purchased.
  • Recall tier: Class members who purchased one or more Breckenridge duloxetine prescriptions that between Aug. 4, 2020, and May 22, 2025, that were subject to a product recall before May 22, 2025, can submit to receive a single payment of $7.50, regardless of the number of prescriptions purchased.
  • Recall-plus tier: Class members can submit to receive $10 per prescription purchased between Aug. 4, 2020, and May 22, 2025, that was subject to a product recall before May 22, 2025, and could not be used due to the recall.

How to claim a class action rebate

To claim a settlement payment, a claim form must be submitted by the deadline of Dec. 27, 2025. Class members can file the online claim form or download a personalized claim form from the same link to print and mail to the settlement administrator.

Is proof required to submit a claim?

Yes, proof is required for each type of claim:

  • Non-recall tier claims require proof of purchase of the Breckenridge duloxetine, which may include a pharmacy receipt, pharmacy records or insurance records showing the purchase date and price.
  • Recall tier claims require the same proof of purchase of the Breckenridge duloxetine as non-recall tier claims. Class members must also provide additional pharmacy documentation indicating the lot number, or expiration date and NDC of the recalled medication.
  • Recall-plus tier claims require proof of purchase and recall information as recall tier claims. Class members must also return the unused recalled duloxetine or submit a signed certification, attesting that the medication was not used.

Breckenridge Pharmaceutical settlement fund

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: $150,000
  • Service award to class representative: $1,500
  • Payments to approved claimants: Total amount determined by number of valid claims filed.

  • Opt-out deadline: Aug. 18, 2025
  • Fairness hearing: Sept. 23, 2025
  • Deadline to file a claim: Dec. 27, 2025

When is the Breckenridge Pharmaceutical duloxetine payout date?

Payments will issued to class members with valid claims after the court grants final approval of the settlement and claim processing is complete.

Why was there a class action settlement?

The class action lawsuit alleged that Breckenridge Pharmaceutical Inc. sold generic duloxetine containing an impurity (NDLX) that may be harmful and made the product economically worthless. Plaintiffs claimed this violated federal regulations and caused economic losses.

Breckenridge denies the allegations but agreed to settle to avoid the risks and expense of continued litigation and a possible trial.
