
Individuals who are a current or former patient or employee of Omni Family Health, whose personal information may have been compromised in a 2024 data breach, may qualify to submit a claim for up to $5,000 plus additional cash and credit monitoring from a class action settlement.
Omni Family Health has agreed to pay $6.5 million to settle a class action lawsuit related to an alleged data breach. The class action claims that hackers posted sensitive personal information of patients and employees on the dark web.
Who can file a a data breach settlement claim?
Class members must meet the following criteria:
- They reside in the United States and their personal information was potentially compromised as a result of the data incident that Omni Family Health discovered on or about Aug. 7, 2024.
- They are a current or former patient or employee of Omni Family Health.
There is also a subclass for California residents:
- All settlement class members who resided in California at any time between Aug. 7, 2024 and the claim deadline of Jan. 5, 2026.
How much is the class action payout?
Class members can submit to receive one or more of the following:
- Out-of-pocket losses: Class members can claim up to $5,000 for documented, unreimbursed expenses related to the data breach. Eligible expenses include:
- Losses from fraud or identity theft
- Professional fees, including attorneys, accountants, or credit repair services
- Costs to freeze or unfreeze credit with any credit reporting agency
- Credit monitoring costs incurred after the breach
- Miscellaneous expenses, including notary, postage, copying and mileage
- Pro rata cash fund payment: Individuals can submit to receive a cash payment from the remaining settlement fund after other expenses and claims are paid. The estimated payment is $105.56 per valid claimant if 4% of class members submit claims. Final payment amount will be determined the number of valid claims filed.
- Credit monitoring and medical shield: All class members can elect to receive two years of Medical Shield Complete by CyEx, which includes monitoring for medical information exposure, one-bureau credit monitoring, and $1 million in identity theft protection.
- California subclass pro rata payment: Class members residing in California during the qualifying period can submit to receive an additional payment estimated at $100. Final payment amount will be determined by the number of valid claims filed.
How to claim a class action rebate
To receive a settlement payment, a claim form must be submitted by the Jan. 5, 2026 deadline. Class members can file a claim online or print the PDF claim form to mail the settlement administrator.

- Notice ID and Confirmation Code from settlement notice required to submit an online claim.
- Out-of-pocket losses claims require supporting documentation which may include receipts or invoices for expenses and services, bank or credit card statements showing unreimbursed fraudulent charges, police report and other proof of identity theft or fraud.

- Venmo
- Zelle
- Physical check mailed to address provided on claim form
$6.5 Million data breach settlement fund
The $6,500,000 settlement fund includes:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $2,166,666.67
- Attorneys' expenses: To be presented to the court for approval at a later date
- Service awards to class representatives: $1,500 each, $30,000 total
- Credit monitoring and medical shield: Cost determined by number of claims filed
- Payments to approved claimants: Remaining settlement funds

When is the Omni Family Health data breach payout date?
Payments will be distributed to class members with valid claims approximately 60 days after the court grants final approval of the settlement.
Why was there a class action settlement?
This class action lawsuit was filed after Omni Family Health discovered that hackers had allegedly posted sensitive personal information of patients and employees on the dark web. The plaintiffs alleged that Omni Family Health failed to adequately protect this information.
Omni Family Health denies these allegations but agreed to settle to avoid the risk and expenses of ongoing litigation.
