Travelers Indemnity New Jersey PIP Class Action Settlement

Individuals who paid for personal injury protection coverage with Travelers under a New Jersey automobile insurance policy and received a payment within $3,000 of their policy limit (but not the full limit) between April 14, 2017, and April 1, 2023, may be eligible to claim $70 or more from a class action settlement.

Travelers Indemnity Co. and St. Paul Protective Insurance Co. agreed to resolve a lawsuit alleging they improperly reduced PIP coverage limits for New Jersey policyholders by factoring in deductibles and copayments, which resulted in some insureds not receiving the full amount of PIP benefits available under their policies.

Who can file a claim?

Class members must meet all of the following criteria:

  • They were a policyholder or insured under a New Jersey automobile insurance policy Travelers Indemnity Co. or St. Paul Protective Insurance Co. issued.
  • Their policy included personal injury protection coverage.
  • Travelers or St. Paul Protective Insurance Co. paid them PIP benefits.
  • Travelers or St. Paul Protective Insurance Co. paid the final payment on their PIP claim between April 14, 2017, and April 1, 2023.
  • They received a payment within $3,000 (inclusive) of their PIP policy limit but not the full PIP policy limit.

The class also includes heirs, executors, administrators, successors and assigns of eligible policyholders or insureds.

There are two main groups within the class based on how the insurer’s records reflect the class member's policy:

  • Individuals whose claims Travelers’ computerized records documented as having PIP policy limits available and whom the companies paid PIP benefits within $3,000 of those limits
  • Individuals whose claims Travelers’ computerized records do not document as having PIP policy limits available but whom the companies paid PIP benefits within $3,000 of an actual New Jersey PIP limit they sold

How much can class members get?

Every class member who does not opt out of the settlement will automatically receive a $70 payment.

In addition, class members who submit a valid claim form may be eligible for a supplemental payment, depending on their individual circumstances. If Travelers or St. Paul Protective Insurance Co. reduced the class member's PIP policy limit by deductibles or copayments, they may receive 80% of the difference between their PIP policy limit and the amount of PIP benefits they paid minus the $70 automatic payment.

How to claim a class action settlement payment

To receive more than the automatic $70 payment, class members must file a claim. They can file a claim online or download and print the PDF claim form.pdf), complete it and mail it to the settlement administrator. The claim deadline is June 16, 2026.

Class members who do nothing will still receive the automatic $70 payment.

Required information

All class members must provide the unique ID from the settlement notice they received. Online claimants must also provide the PIN from the same notice.

Payout options

The settlement administrator will mail checks to the address on file or provided on the claim form.

Settlement fund

The settlement fund includes:

  • Settlement administration costs:To be determined
  • Attorneys’ fees and costs: Up to $275,000
  • Service awards to class representatives: $2,500 each to three named plaintiffs ($7,500 total)
  • Payments to eligible class members: The remainder of the fund

Important dates

  • Deadline for exclusion: March 18, 2026
  • Final approval hearing: April 17, 2026
  • Deadline to submit a claim form: June 16, 2026

When is the Thompson, Thorson and Lucci v. Travelers payout date?

The settlement administrator will send the $70 automatic payments within 30 days of the court granting final approval to the settlement. It will send supplement payments within 75 days of the court granting final approval to the settlement or within 45 days after a neutral evaluator’s decision (if a class member appeals a claim).

Why did this class action settlement happen?

The class action lawsuit alleged Travelers Indemnity Co. and St. Paul Protective Insurance Co. failed to pay the full amount of PIP benefits to New Jersey insureds by reducing policy limits for deductibles and copayments.

The defendants deny any wrongdoing but agreed to settle to avoid the costs and risks of continued litigation.
