Current and former patients who received a notification from Monte Nido Holdings that their private information was involved in the data breach reported in August 2024, you may be eligible to claim up to $2,600 from a class action settlement.
Monte Nido Holdings LLC has agreed to pay $750,000 to settle a class action lawsuit regarding allegations that the company failed to adequately protect sensitive personal information during a data breach. The breach, which occurred in September 2023, potentially exposed the private information of approximately 41,600 individuals.
Who can file a claim?
General settlement class: All individuals whose private information may have been compromised as a result of the Monte Nido data breach in August 2024, and were notified by Monte Nido.
California subclass: All class members residing in California whose information may have been involved in the Monte Nido data breach.
How much is the settlement payout?
Class members can claim one or more of the following benefits
- Cash payment A – Ordinary losses: Class members can claim up to $250 for documented out-of-pocket expenses and lost time. Lost time is capped at four hours at $20 per hour.
- Cash payment B – Extraordinary losses: Class members can claim up to $2,500 for monetary losses resulting from identity theft, if the loss was more likely than not traceable to the data breach, occurred between Sept. 16, 2023, and Nov. 6, 2025, and the claimant made reasonable efforts to seek reimbursement elsewhere.
- Cash payment C – Flat cash payment: Class members that do not submit an ordinary or extraordinary losses claim can submit to receive an estimated $50 flat cash payment.
- Cash Payment D – California statutory payment: Class members who are California residents may claim an additional estimated $100 cash payment.
- Credit Monitoring: All class members can elect to receive one year of three-bureau credit monitoring with three-bureau coverage and $1,000,000 in identity theft protection insurance.
How to claim a class action rebate
To receive a settlement payment or credit monitoring services, class members can file a claim online or download and mail the PDF claim form to the settlement administrator.

Required proof and claim information
- Class Member ID from official settlement notice required to submit a claim.
- Ordinary losses claims require supporting documentation such as receipts or bills showing out-of-pocket expenses related to the data incident.
- Extraordinary losses claims require supporting documentation of actual, unreimbursed monetary loss, proof it was caused by the data incident, and evidence of efforts to seek reimbursement elsewhere. This may include credit card and bank statements, invoices, police report, correspondence and other proof of identity theft or fraud.
- California statutory payment claims require the California address resided at between Sept. 16, 2023 and Nov. 6, 2025.
- Credit Monitoring: No documentation beyond confirming eligibility

When is the Monte Nido data breach settlement payout date?
Payments and credit monitoring codes will be issued to approved claimants approximately 75 days after the settlement is granted final approval.
Why did this class action settlement happen?
This class action lawsuit was filed after Monte Nido detected unauthorized access to its computer systems between Sept. 16 and Sept. 22, 2023. The cybersecurity incident potentially exposed private information of about 41,600 individuals. Plaintiffs alleged that Monte Nido failed to adequately protect this information.
Monte Nido denies the allegations but agreed to settle to avoid the expense and uncertainty of further litigation.
