Individuals who received a consumer file disclosure letter from MIB Group Inc. or MIB LLC between Jan. 29, 2022, and May 14, 2025, that referenced medical information from a service provider may qualify to claim approximately $140 from a class action settlement.

MIB Group Inc. and MIB LLC agreed to pay $2.425 million to resolve a class action lawsuit alleging violations of the Fair Credit Reporting Act. The lawsuit claimed MIB failed to properly identify all sources of information in its consumer file disclosures, specifically when referencing medical information from service providers.

Who are the class members?

The class includes all individuals who meet the following criteria:

  • They have an address in the United States, including all territories and political subdivisions.
  • They received a consumer file disclosure letter from MIB between Jan. 29, 2022, and May 14, 2025.
  • The disclosure letter specifically included a record referencing medical information from a service provider.

There are approximately 11,000 members in the settlement class. Individuals who received a notice by mail or email are likely included in the class. The settlement administrator used MIB’s records to identify class members and therefore already contacted most eligible individuals.

How much can class members receive?

The total settlement fund is $2,425,000. After deducting attorneys’ fees, litigation expenses, administrative costs and a service award to the plaintiff, the settlement administrator will distribute the remainder of the fund equally among all class members who do not exclude themselves from the settlement. The expected payment amount is approximately $140 per person.

If fewer people are eligible for the settlement than estimated or some checks go uncashed, the settlement administrator may redistribute the remaining amount or donate it to a charitable organization (cy pres recipient) as specified in the settlement agreement.

No claim form needed to receive payment

Class members do not need to file a claim to receive a payment. The settlement administrator will automatically mail them to the address on file with MIB. Those who wish to update their address or select a digital payment option can do so by visiting the settlement website.

$2.43 million settlement fund breakdown

The $2,425,000 settlement fund includes:

When is the MIB FCRA class action settlement payout date?

The settlement administrator will issue payments approximately 21 days after the court resolves any appeals and grants final approval to the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged MIB failed to properly identify all sources of information in its consumer file disclosures, specifically when referencing medical information from service providers. The plaintiff claimed this violated section 1681g(a)(2) of the FCRA.

MIB denied any wrongdoing but agreed to settle to avoid the expense and uncertainty of further litigation. As part of the settlement, MIB will also implement changes to its practices regarding disclosure of information sources.
