Consumers whose private information the January 2025 Medical Associates of Brevard data breach may have impacted could be eligible to claim up to $1,500 for documented losses and/or receive one year of medical data monitoring from a class action settlement.

Medical Associates of Brevard agreed to pay $300,000 to settle a class action lawsuit alleging the company failed to adequately protect sensitive information, such as names, Social Security numbers and health data, resulting in a data breach.

Who is eligible to file a claim?

  • The settlement class includes all living individuals residing in the United States whose private information the January 2025 Medical Associates of Brevard data incident may have been impacted.
  • Class members may have received a notice directly from Medical Associates of Brevard informing them the breach affected their information.
  • Patients whose information Medical Associates of Brevard stored during the relevant period may be included.

How much can class members get?

  • Cash payment for documented losses: Up to $1,500 for documented out-of-pocket losses resulting from the data breach between Jan. 24, 2025, and Dec. 1, 2025. Covered expenses include:
    • Losses due to identity theft or fraud
    • Fees for credit reports, credit monitoring or freezing/unfreezing credit related to the breach
    • Costs to replace IDs due to the breach
    • Postage to contact banks by mail related to the breach

Expenses already reimbursed by a third party are not eligible for reimbursement.

  • Medical data monitoring: One year of CyEx Medical Shield Pro, which includes $1 million in medical identity theft insurance and monitoring for health care insurance ID exposure, medical record number exposure and unauthorized health savings account spending.

How to claim a class action payment

Class members can file a claim online or download, print and complete a PDF claim form and mail or email it to the settlement administrator. They can also request a paper copy of the claim form by calling the settlement administrator. The claim deadline is Dec. 1, 2025.

Information required

Claimants must provide documentation to support claims for out-of-pocket losses. Acceptable proof includes:

  • Bank statements
  • Receipts
  • Other supporting documents showing the data incident caused the expense

Self-prepared notes or papers may supplement but cannot replace other proof

Class members do not need to submit documentation to claim the medical data monitoring service; they only need to check the appropriate box on the claim form.

To file an online claim form, class members must log in with the unique ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@MedAssociatesBrevardDataBreach.com and providing their full name and mailing address.

When is the Medical Associates of Brevard data incident settlement payout date?

The settlement administrator will distribute payments and benefits approximately 105 days after the court grants final approval of the settlement barring any appeals.

Why is there a class action settlement?

The class action lawsuit alleged a targeted cyberattack on Medical Associates of Brevard’s computer systems in January 2025 exposed files containing sensitive information, including names, Social Security numbers and health data. The plaintiffs claimed the company failed to adequately protect this information.

Medical Associates of Brevard denies wrongdoing but agreed to settle to avoid the cost, disruption and uncertainty of continued litigation.
