
Individuals whose private information the July 2023 M&D Capital Premier Billing data breach potentially compromised may be eligible to claim up to $5,000 or a $75 cash payment from a class action settlement.
M&D Capital Premier Billing agreed to settle a class action lawsuit alleging a July 2023 data incident allowed unauthorized access to systems containing private information. The lawsuit claims the incident exposed sensitive personal and medical data belonging to individuals whose information M&D Capital maintained.
Who can file a claim?
The settlement class includes individuals whose private information was compromised during the data incident discovered on or about July 8, 2023.
How much can class members get?
Class members can select one cash payment and may also receive medical monitoring:
- Documented losses: Class members may claim up to $5,000 for documented, unreimbursed expenses related to the data incident. Class members must provide proof. Eligible losses may include:
- Bank fees
- Long distance phone charges
- Cell phone charges billed by the minute
- Data charges billed based on usage
- Postage
- Gasoline for local travel
- Fees for credit reports
- Fees for credit monitoring or identity theft insurance products
- Flat cash payment: Class members may request a one time $75 cash payment.
- Medical monitoring: Class members may elect to receive two years of medical monitoring services.
- Pro rata cash adjustment: The claims administrator will adjust all cash payments on a pro rata basis depending on the number of valid claims and the fund after deductions.
How to claim a settlement payment
Class members must submit a claim form by the Jan. 27, 2026, deadline. They can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

What proof or documentation is required to submit a claim?
- For reimbursement of documented losses, class members must provide documents such as receipts, invoices, bank statements or other records.
- For the flat cash payment, class members only need to select the option on the claim form.
- For the medical monitoring option, class members need only to select the option on the claim form.

When is the M&D Capital Data Breach Litigation payout date?
The settlement administrator will distribute payments to class members with valid claims within 75 days after the court grants final approval of the settlement.
