Individuals who received a notice that a data breach at Managed Care of North America Inc. may have impacted their private information between Feb. 26, 2023 and March 7, 2023, could qualify to submit a claim for up to $2,500 and credit monitoring from a class action settlement. The cybersecurity incident affected as many as 8.9 million people.

Managed Care of North America Inc., MCNA Insurance Co. and Healthplex Inc. agreed to a settlement resolving a class action lawsuit regarding alleged negligence and breach of implied contract after a data breach exposed sensitive personal and health information. Exposed information included dates of birth, Social Security numbers and health insurance details.

Who can submit a claim for a data breach payout?

Class members are individuals in the United States who received a notice stating the 2023 MCNA data breach potentially impacted their private information.

How much can class members get?

Class members have the following benefit options:

  • Cash payment for documented out-of-pocket losses: Class members can claim up to $2,500 for documented unreimbursed expenses and losses due to identity theft or fraud that occurred before March 7, 2026, and are traceable to the data breach. The settlement caps the total fund for these payments at $250,000. If the total amount of valid claims exceeds this cap, the settlement administrator will reduce payments on a pro rata basis.
  • Medical data monitoring: All class members can elect to enroll in two free years of CyEx’s Medical Shield Complete. Services include financial and identity data protection, medical data monitoring and fraud insurance. They do not need to submit a claim form to receive this benefit.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof and claim information

  • To submit a claim online, claimants must provide the class member ID from the settlement notice they received.
  • To submit a documented out-of-pocket losses claim, claimants must provide supporting documentation. This includes receipts, invoices, bank or credit card statements and other proof of identity theft or fraud the breach caused and that the claimant made efforts to recover the losses.

  • Documented losses payments to claimants: Up to $250,000

When is the MCNA data breach settlement payout date?

The settlement administrator will activate medical monitoring enrollment codes approximately 60 days after the court grants final approval of the settlement. It will issue cash payments to approved claimants approximately 75 days after the final approval date.

Why is there a class action settlement?

The class action lawsuit alleged MCNA, MCNA Insurance Co. and Healthplex Inc. failed to adequately protect the personal and health information of individuals, resulting in a data breach between Feb. 26, 2023, and March 7, 2023. The plaintiffs claimed negligence and breach of implied contract.

The defendants denied any wrongdoing but agreed to settle to avoid the expense and risk of continued litigation and a possible trial.
