Who is eligible for a Loyola University Medical Center payout?
Class members must have logged into the Loyola University Medical Center MyChart patient portal at least once between Jan. 1, 2018, and Dec. 31, 2022.
How much is the data privacy payment?
Pro rata payment: Each eligible class member who submits a valid claim will receive a cash payment. The exact amount each person will receive depends on the total number of valid claims submitted and the net amount remaining in the settlement fund after deductions.
If any money remains in the net settlement fund 150 days after payments are issued (for example, if some checks are not cashed), those funds will be distributed again, pro rata, to claimants who cashed or deposited their initial payment or received their payment digitally as long as the additional payment would be at least $5 per person. If the remaining amount is too small, it will be donated to the American Red Cross.

Why did this class action settlement happen?
The class action lawsuit alleged Loyola University Medical Center used Meta Pixel and Google Analytics tracking tools on its website and patient portal between Jan. 1, 2018, and Dec. 31, 2022. The plaintiffs claimed these tools resulted in the unauthorized disclosure of personal health information to third parties and violated federal and Illinois law, including the Electronic Communications Privacy Act, the Illinois Consumer Fraud and Deceptive Business Practices Act and the Illinois Eavesdropping Statute.
LUMC denies any wrongdoing, and the settlement does not constitute an admission of liability. The parties agreed to settle to avoid the risks and uncertainty of continued litigation.
