Labcorp $6.1 Million Data Breach Class Action Settlement

Labcorp employees or individuals who received or paid for laboratory tests a Planned Parenthood health center ordered on or before Oct. 27, 2024, may be eligible to submit a claim for up to $6,000 and/or credit monitoring from a class action settlement. Laboratory Services Cooperative discovered the data breach in October 2024. It impacted approximately 1.6 million people.

Labcorp agreed to pay $6.1 million to settle a class action lawsuit alleging a data breach exposed the personal and health information of current and former patients and employees. The cyberattack compromised personally identifiable information and protected health information, which included names, dates of birth, Social Security numbers and medical records, including lab results.

Who can file a claim for a data breach payout?

Class members must meet the following criteria:

• They reside in the United States.
• They are a current or former employee or customer whose personal information the Labcorp data breach discovered on or about Oct. 27, 2024, potentially compromised.
• Labcorp must have employed qualifying current and former employees on or before Oct. 27, 2024.
• A Planned Parenthood health center must have ordered and current and former customers must have a received or paid for laboratory tests on or before Oct. 27, 2024.

How much are settlement payments?

Class members have the following benefit options:

• Compensation for unreimbursed economic losses: Class members can claim up to $5,000 for documented out-of-pocket losses traceable to the data breach. This includes unreimbursed monetary losses due to identity theft or fraud; professional fees, such as attorneys, accountants or credit repair services; costs for freezing/unfreezing credit; costs for credit monitoring after the incident; and other expenses, such as postage for contacting financial institutions.
• Cash fund payment: All class members can submit a claim for a pro rata cash payment of up to $1,000 from the net settlement fund after the settlement administrator pays all out-of-pocket losses and credit monitoring claims. The administrator will determine the final payment amount by the total number of valid claims filed.
• Credit and medical monitoring: All class members can elect to receive two free years of CyEx Medical Shield Complete. Services include one-bureau credit monitoring, $1 million in identity theft protection and comprehensive monitoring for medical information exposure.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof and claim information

• Out-of-pocket losses claims require supporting documentation, which may include receipts, invoices for services, bank or credit card statements, and other proof of fraud or identity theft.
• Class members who received or paid for Planned Parenthood lab testing services must include the patient first and last name, city and state of the Planned Parenthood Health Center visited and the patient date of birth.

The settlement administrator may request additional information at a later date.

Settlement fund breakdown

When is the Labcorp data breach settlement payout date?

The settlement administrator will issue payments to approved claimants after it resolves any appeals and grants final approal to the settlement.
