Liberty Mutual Fire Insurance Company has agreed to pay $571,200 to settle a class action lawsuit for allegedly failing to pay for diminished value under their Washington insurance policy’s UIM PD coverage.
Who Can File a Claim?
To be eligible to file a claim:
- You were insured by Liberty Mutual Fire Insurance Company or LM General Insurance Company with a Washington auto policy.
- You received payment under the UIM PD provision for accidents occurring between November 7, 2016, and July 19, 2024.
- Your vehicle's repair estimates totaled at least $1,000, and the amount paid for physical damage (plus the deductible) was at least $1,000.
- Your vehicle was no more than six years old and had less than 90,000 miles at the time of the accident.
- Your vehicle suffered structural damage, deformed sheet metal, or required body or paintwork.
How Much Can Class Members Get?
The amount each class member can receive varies based on individual vehicle repair costs.
Each eligible class member will receive a payment calculated by multiplying the portion of the settlement payable to class members by the fraction that the individual repair costs represent of the class's total repair costs.
For example, if the settlement fund available to class members is $571,200 minus attorneys’ fees and costs, and service award payments to the class representatives, the remaining amount will be distributed proportionally based on each member’s repair costs.
Example: If a class member's repair costs are $2,000 and the total class repair costs are $200,000, the member would receive a proportional share of the remaining settlement fund.
How to Claim an Award
To claim an award, you must submit a claim form either online or by mail. You can file a claim online or download a claim form to mail it in. Ensure your claim form is postmarked by February 3, 2025.
