
Individuals who scanned their hand or finger for timekeeping purposes while working at the Lemont Grove Advisors LLC Shop & Save Market store in Illinois between March 11, 2015, and February 2019 may be eligible to claim an estimated $600 from a class action settlement.
Lemont Grove Advisors LLC agreed to pay $461,250 to resolve a class action lawsuit alleging it violated the Illinois Biometric Information Privacy Act by collecting hand or finger scans from employees without following legal notice and consent requirements.
Who are the class members?
Class members must meet all of the following criteria:
- They scanned their hand or finger using Lemont Grove Advisors LLC’s timekeeping system.
- The scan occurred at the Lemont Grove Advisors LLC Shop & Save Market store in Illinois.
- The scan occurred at any time between March 11, 2015, and February 2019.
Company records identified approximately 450 class members who meet these criteria.
Who is excluded from the class?
Certain individuals are not eligible to participate in the settlement, including:
- Anyone who submits a timely and valid request for exclusion from the settlement
- Individuals who previously executed a release under BIPA
- Individuals who were members of a collective bargaining agreement
- Anyone who has already released their claims in previously dismissed related actions
How much can class members get?
Pro rata payment: Each class member who does not opt out of the settlement will receive an equal share of the net settlement fund. The estimated payment is about $600 per person, but the settlement administrator will determine the final amount based on deductions for attorneys' fees and costs, settlement administration costs and a service award to the class representative, as well as the total number of valid claims.
No action needed to receive payment
Class members do not need to file a claim to receive payment. If the settlement administrator identifies them as a class member, it will automatically mail a check to their last known address after the court grants final approval of the settlement.
$461,250 settlement fund breakdown
The $461,250 settlement fund includes:
- Settlement administration costs: To be determined
- Attorneys’ fees: Up to $170,662.50
- Attorneys' costs and expenses: To be determined
- Service award to class representative: Up to $5,000
- Payments to eligible class members: The remainder of the fund
If the number of class members is above or below 450, the settlement administrator will adjust the fund by $1,025 for each class member above or below that number.

When is the Lemont Grove Advisors BIPA settlement payout date?
The settlement administrator will issue payments to eligible class members approximately 28 days after the court’s final approval of the settlement.
