
Individuals who received a notice around Feb. 1, 2024, from Knight Barry Title Inc. about a data incident may be eligible to claim up to $5,000 plus a pro rata payment and credit monitoring from a class action settlement.
Knight Barry Title Inc. agreed to pay $1.1 million to settle a class action lawsuit alleging it failed to adequately protect personal information during a ransomware attack that occurred in August 2023.
Who can file a claim?
Class members must have received a notice on or around Feb. 1, 2024, from Knight Barry Title Inc. about the data incident.
How much can class members get?
- Reimbursement for out-of-pocket losses: Up to $5,000 per individual for losses fairly traceable to the data incident and supported by documentation. Eligible expenses include:
- Costs incurred on or after Aug. 15, 2023, for accessing, freezing or unfreezing credit reports
- Miscellaneous expenses, such as notary, fax, postage, copying and mileage
- Credit monitoring or other mitigative costs incurred after Aug. 15, 2023, through Feb. 17, 2026
- Pro rata cash payment: The settlement administrator will determine the pro rata cash payment after deducting attorneys' fees, service awards, administrative costs and all valid claims for out-of-pocket losses and identity theft protection from the $1.1 million settlement fund. It will divide the remaining amount equally among all valid claimants.
- Identity theft protection and credit monitoring: All class members who submit a valid claim can receive three years of free identity theft protection and credit monitoring, which includes:
- Credit monitoring with at least one major credit reporting agency
- Identity restoration and recovery services
- $1,000,000 in identity theft insurance with no deductible
How to claim a settlement payment
Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Feb. 17, 2026.

What proof or documentation is required to submit a claim?
- All class members must provide the class member ID located on the settlement notice they received.
- To receive reimbursement of out-of-pocket losses, class members must provide documentation, such as receipts, bills or statements. Handwritten receipts alone are not sufficient, but the class member may use them to clarify other documentation.
- To receive the pro rata cash payment and/or identity theft protection, class members must certify they received the notice and are eligible for the settlement.

When is the Knight Barry Title Inc. data incident payout date?
The settlement administrator will distribute payments and benefits after the court resolves any appeals and grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Knight Barry Title Inc. experienced a ransomware cyberattack on or about Aug. 15, 2023, that allegedly compromised the personal identifying information of clients and former clients. The plaintiffs claimed that Knight Barry Title Inc. failed to adequately protect their private information.
The company denies any wrongdoing, but both parties agreed to settle to avoid the cost and risk of continued litigation and to provide compensation to those affected.
