Consumers who were charged for the automatic renewal of an IdentityIQ membership between March 22, 2019, and Aug. 20, 2023, may be eligible for a cash payment from a class action settlement.

Identity Intelligence Group LLC has agreed to pay $8,769,854 to settle a class action lawsuit that alleged the company enrolled California consumers in automatically renewing subscriptions for its IdentityIQ identity theft protection and credit monitoring services without clearly and conspicuously presenting the automatic renewal offer terms, as required by California law.

Who is eligible for a settlement payout?

Class members must meet the following criteria:

  • They are a California resident who was enrolled in an IdentityIQ membership between March 30, 2011 and August 20, 2023.
  • They were charged one or more renewal fees for that membership on or after March 22, 2019.

How much is the IdentityIQ class action payment?

Pro rata cash payment: Each eligible class member will receive an equal share of the net settlement amount.

No claim form required

Eligible class members do not need to submit a claim form in order to receive payment. Class members who received an official settlement notice and should submit a payment selection form on the settlement website using their Web ID.

The deadline to submit a payment method request is July 28, 2025.

Payout options

Class members have the following options:

  • Electronic payment, if a payment method is a submitted by the deadline.
    • PayPal
    • Venmo
    • ACH
  • Paper check mailed to the address provided or last address on file.

$8.77 million autorenewal class action settlement fund

The $8,769,854 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $3,332,545
  • Litigation expenses: Not to exceed $120,000
  • Service awards to class representatives and others: Up to $50,000
  • Payments to eligible class members: Remaining settlement funds

  • Final fairness approval hearing: Sept. 19, 2025

When is the IdentityIQ autorenewal settlement payout date?

Payments will be issued to eligible class members approximately 121 days after the court grants final approval of the settlement.

Why did this class action lawsuit and settlement happen?

This class action lawsuit alleged that Identity Intelligence Group, LLC violated California’s Automatic Renewal Law and Unfair Competition Law by enrolling California consumers in automatically renewing IdentityIQ subscriptions without clearly and conspicuously presenting the renewal terms.

The company denied all allegations, but agreed to a settlement in order to avoid further litigation and provide compensation to affected consumers.
