Individuals whose personal or protected health information a data breach at Henderson & Walton Women’s Center that occurred between Feb. 11, 2022, and Feb. 14, 2022, potentially compromised may be eligible to submit a claim for up to $2,740 from a class action settlement.

Henderson & Walton Women’s Center PC agreed to settle a class action lawsuit alleging negligence, negligence per se, breach of implied contract, breach of fiduciary duty and unjust enrichment after unauthorized parties accessed its computer systems and exposed sensitive patient information. The cybersecurity incident compromised personal and protected health information belonging to approximately 34,000 current and former patients.

Who can file a claim for a data breach payout?

Class members are individuals whose personal information and/or protected health information the data breach at Henderson & Walton Women’s Center that occurred between Feb. 11, 2022, and Feb. 14, 2022, potentially compromised.

How much are settlement payments?

Class members have the following benefit options:

  • Ordinary losses: Class members can claim up to $150 per person for documented out-of-pocket expenses related to the data breach. Eligible expenses include bank fees, postage for communication with financial institutions and fees for credit reports, credit monitoring or identity theft insurance purchased between August 2022 and Aug. 27, 2026.
  • Extraordinary losses: Class members can claim up to $2,500 for documented extraordinary losses the data breach directly caused, such as identity theft or fraud.
  • Compensation for lost time: Class members can claim up to three hours of time at $30 per hour ($90 maximum) for time spent dealing with issues related to the data breach.
  • Medical and credit monitoring: All class members can elect to receive three years of one-bureau credit monitoring, which includes real-time monitoring, dark web scanning, public record monitoring, identity theft insurance with no deductible and access to fraud resolution agents.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof and claim information

  • To submit a claim, class members must provide the notice ID from the settlement notice they received to submit a claim online. Online claimants must also provide the confirmation code from the same notice.
  • Ordinary losses claims require supporting documentation, which may include receipts or third-party invoices for expenses.
  • Extraordinary losses claims require supporting documentation, such as identity theft reports, affidavits, police reports, bank statements showing unreimbursed fees or fraudulent charges, correspondence with financial institutions and other evidence of unreimbursed monetary losses.
  • Lost time claims require a description of how the class member spent time dealing with the data incident.

Settlement fund breakdown

When is the Henderson & Walton Women’s Center data breach payout date?
