Current and former patients who received notification that the November 2024 data breach involving WPM Pathology Laboratory or Salina Regional Health Center compromised their private information may qualify to submit a claim for up to $4,000 from a class action settlement. WPM Pathology Laboratory and Salina Regional Health Center agreed to settle a class action lawsuit. The complaint alleges the companies failed to adequately protect sensitive personal and health information, which an unauthorized party accessed during a targeted cyberattack in November 2024. The exposed information may have included dates of birth, Social Security numbers, diagnosis details, medical record numbers and health insurance claims information.

Who can file a claim for a data breach payout?

Class members are individuals whose private information the data breach compromised, including those whom tge defendants directly notified.

How much can class members get?

Class members have the following benefit options:

  • Reimbursement for documented ordinary out-of-pocket expenses: Class members can claim up to $400 for documented out-of-pocket expenses incurred between Nov. 4, 2024, and Oct. 19, 2026, that are related to the data breach. Examples include fees for credit reports, credit monitoring, freezing or unfreezing credit or replacing IDs, or postage to contact banks.
  • Reimbursement for documented extraordinary out-of-pocket losses: Class members can claim up to $4,000 for monetary losses due to identity theft or fraud that occurred between Nov. 4, 2024, and Oct. 19, 2026, that the data breach most likely caused.
  • Reimbursement for lost time: Class members can claim up to four hours at $20 per hour, a maximum of $80, for time spent responding to the data breach. This includes time spent changing passwords, investigating suspicious activity or researching the breach.
  • Alternative cash payment: Class members who do not submit an ordinary out-of-pocket expenses, extraordinary out-of-pocket expenses or lost time claim can submit a claim to receive a one-time cash payment of $45.
  • Two years of CyEx Identity Defense Complete credit monitoring: All class members can claim this benefit, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and comprehensive public records monitoring.

How to claim an award

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof and claim information?

  • For reimbursement of ordinary or extraordinary out-of-pocket expenses, claimants must provide proof, such as receipts or other supporting documents, showing the amount spent or lost, and its relation to the data breach. Self-made notes or explanations alone are not sufficient.
  • For lost time claims, claimants must briefly describe the tasks performed in response to the breach. They do not need to provide documentation.
  • For online claims, claimants need to provide the ID and PIN they received in their settlement notice.
