Current and former patients who received notification that their private information was compromised in the November 2024 data breach involving WPM Pathology Laboratory or Salina Regional Health Center, may qualify to submit a claim for up to $4,000 from a class action settlement. The cybersecurity incident impacted approximately 5,619 individuals.
WPM Pathology Laboratory and Salina Regional Health Center agreed to pay to settle a class action lawsuit. The complaint alleges the companies failed to adequately protect sensitive personal and health information, which was accessed during a targeted cyberattack in November 2024. The exposed information may have included dates of birth, Social Security numbers, diagnosis details, medical record numbers and health insurance claims information.
Who can file a claim for a data breach payout?
Class members are individuals whose private information was accessed in the data breach, including those who were directly notified by the defendants.
How much can class members get?
Class members have the following benefit options:
- Reimbursement for documented ordinary out-of-pocket expenses: Class members can claim up to $400 for documented out-of-pocket expenses incurred between Nov. 4, 2024 and Oct. 19, 2026, and were a result of the data breach. Examples include fees for credit reports, credit monitoring, freezing or unfreezing credit, replacing IDs or postage to contact banks.
- Reimbursement for documented extraordinary out-of-pocket losses: Class members can claim up to $4,000 for monetary losses due to identity theft or fraud that occurred between Nov. 4, 2024 and Oct. 19, 2026, and were more likely than not caused by the data breach.
- Reimbursement for lost time: Class members can claim up to four hours at $20 per hour, a maximum of $80, for time spent responding to the data breach. This includes changing passwords, investigating suspicious activity or researching the breach.
- Alternative cash payment: Class members that do not submit an ordinary out-of-pocket expenses, extraordinary out-of-pocket expenses or lost time claim can submit to receive a one-time cash payment of $45.
- Two years of CyEx Identity Defense Complete credit monitoring: All class members can claim this benefit, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and comprehensive public records monitoring.
How to claim an award
To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof and claim information?
- For reimbursement of ordinary or extraordinary out-of-pocket expenses, claimants must provide proof such as receipts or other supporting documents showing the amount spent or lost, and that the expense was due to the data breach. Self-made notes or explanations alone are not sufficient.
- For lost time claims, claimants must briefly describe the tasks performed in response to the breach. No receipts are required.
- Class members filing online need to provide the ID and PIN the received in their settlement notice.

Why did this class action settlement happen?
The class action lawsuit was filed after a targeted cyberattack in November 2024 compromised the computer systems of WPM Pathology Laboratory. Attackers accessed files containing sensitive personal and health information. The plaintiffs alleged that the WPM and Salina Regional Health Center failed to adequately protect this information.
The defendants deny any wrongdoing, however agreed to settle to avoid the costs and and uncertainties of continued litigation.
