Illinois residents who owned or rented property within three miles of the Chemtool Manufacturing Plant in Rockton, Illinois on June 14, 2021, may qualify to submit a claim for a cash payment from a class action settlement.

Holian Insulation Co. Inc. has agreed to pay $5.5 million to resolve a class action lawsuit over alleged property damage and related losses resulting from a fire at the Chemtool Manufacturing Plant.

Who is eligible for a Chemtool fire settlement payment?

Class members must meet the following criteria:

Individuals who were an Illinois citizen as of June 14, 2021
Residents or entities who owned or rented property located within a three-mile radius of the Chemtool Manufacturing Plant at 1165 Prairie Hill Road, Rockton, Illinois on June 14, 2021

Both residential and non-residential property owners and tenants are included.
Each property within the class area that was owned or rented on the relevant date is eligible for a separate claim.
Legal representatives can file on behalf of deceased or incapacitated individuals, provided they can demonstrate their authority if requested.

How much is the class action payout?

Pro rata cash payment: Approved claimants will receive a monetary award. Payment amount will be determined by:

The number of valid claims filed
Whether the claimant was an owner or tenant
The distance of the property from the Chemtool plant
Whether the property was residential or non-residential
The number of people living at the property on June 14, 2021

How to claim a settlement payment

Class members that previously submitted for the Chemtool $94.5 million settlement do not need to submit a new claim for this settlement.

Class members that did not submit for the previous Chemtool settlement must submit a claim by the deadline of Oct. 13, 2025 in order to receive a payment. Claims can be submitted using the online claim form or by printing the PDF claim form to complete and mail to the settlement administrator.

Class members who owned or rented multiple properties within the class area must submit a separate claim for each property.

Required proof and claim information

Claim Number and PIN from settlement notice required to submit an online claim.
Claimants must provide insurance claim information if an insurance claim was submitted for property damage or items of personal property due to the Rockton Plant fire on June 14, 2021.
All claims require supporting documentation showing the claimant was an owner or renter of the property. The settlement administrator will accept the following documentation:

Utility bill with corresponding address for the time period including June 14, 2021
Telephone bill with corresponding address for the time period including June 14, 2021
Driver's license or state ID with corresponding address for the time period including June 14, 2021
Rental agreement with corresponding address for the time period including June 14, 2021
Other documents showing address and dates of ownership or residence as a tenant for the time period including June 14, 2021

Payout options

Class members mailing in a paper claim form will receive a check mailed to the address provided.

$5.5 Million class action settlement fund

The $5,000,000 settlement fund will include:

Attorneys' fees: Up to $1,925,000
Attorneys' expenses: To be presented to court for approval at a later date

When is the Holian Insulation Co. class action settlement payout date?

Payments to approved claimants will be issued after the court grants the settlement final approval and all claim processing is complete.

Why did this class action settlement happen?

The class action lawsuit alleged that Holian Insulation Co. Inc., a contractor working at the Chemtool Manufacturing Plant, was responsible for property damage and related losses caused by a fire that began at the plant on June 14, 2021. Plaintiffs sought compensation for property cleanup costs, diminished property value, loss of use and enjoyment of property, and other damages.

Holian Insulation denied all allegations of wrongdoing. The parties agreed to settle to avoid the risks and cost of continued litigation and a possible trial.
