Consumers who received a notice letter informing them that their personal information may have been compromised in the Houser LLP data breach between May 7, 2023, and May 9, 2023,z may be eligible to submit a claim for up to $5,000 from a class action settlement.

Houser LLP agreed to pay $1,300,000 to settle a class action lawsuit for alleged failure to implement adequate data security safeguards. This class action was filed after an unauthorized third party gained access to files containing sensitive personal information of Houser’s clients’ customers.

Who is eligible for a data breach payout?

The settlement includes three classes:

  • General class: Individuals whose private information was actually or potentially accessed or acquired during the Houser law firm data incident and received a notice from Houser LLP beginning around Feb. 28, 2024.
  • California subclass: California residents whose private information was impacted by the Houser data breach.
  • Washington subclass: Washington State residents whose private information was impacted by the data breach.

How much is the class action settlement payment?

Claimants can select one or more of the following options:

  • $50 cash payment: All class members can submit a claim for a $50 cash payment.
  • Washington $25 cash payment: Washington subclass members can select to receive an additional $25 cash payment.
  • California $100 cash payment: California subclass members can select to receive an additional $100 cash payment.
  • Documented out-of-pocket losses and expenses: All class members may claim up to $5,000 actual, documented and unreimbursed monetary losses or expenses.
    • Losses and expenses must have occurred on or before May 7, 2023 and be fairly traceable to the Houser data breach.
    • Claimants must have made reasonable efforts to seek reimbursement for the any claimed losses.

How to claim a data breach class action rebate

To receive a settlement payment, class members must submit a claim form by the deadline of Oct. 1, 2025. Class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

$1.3 million data breach settlement fund

The settlement fund of $1,300,000 will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $433,333.33
  • Attorneys' expenses: Amount to be presented to the court for approval
  • Service awards to class representatives: Up to $2,000 each ($12,000 total)
  • Payments to approved claimants: Remaining settlement funds

  • Deadline to file a claim: Oct. 1, 2025
  • Final approval hearing: Oct. 31, 2025

When is the Houser LLP data breach settlement payout date?

Payments will be issued to class members with approved claims approximately 90 days after the court grants final approval of the settlement or as soon as claim processing is complete.

Why did this class action lawsuit and settlement happen?

The class action lawsuit was filed after Houser LLP experienced a data breach between May 7, 2023, and May 9, 2023, during which cybercriminals accessed files containing sensitive personal information. Plaintiffs alleged that Houser failed to implement adequate data security safeguards, which allowed the breach to occur.

Houser denies these allegations but agreed to a settlement in order to avoid the cost and risk of further litigation.
