Consumers who received a notice from Heart South Cardiovascular Group PC about a data breach that took place in May 2024 may qualify to submit a claim for up to $5,000 or other benefits from a class action settlement.

Heart South Cardiovascular Group PC agreed to pay $500,000 to settle a class action lawsuit regarding a targeted cyberattack that exposed sensitive patient information. Exposed information included names, addresses, dates of birth, driver’s license numbers, Social Security numbers, diagnoses, lab results, medications and other treatment information.

Who is eligible for a data breach payout?

Class members are individuals residing in the United States whom HSCG sent notification that their personal and protected health information was or may have been compromised by the May 2024 cyberattack.

How much is the class action settlement payment?

Class members may submit for one or more of the following benefits:

  • Pro rata cash payment: Class members may submit to receive a cash payment estimated at $50. After all claims and settlement expenses are paid, the remaining funds will be divided equally among all class members who submit a valid claim for this payment.
  • Reimbursement for out-of-pocket losses: Class members who experienced documented and unreimbursed financial losses after May 29, 2024, as a result of the data breach may claim up to $5,000. Eligible expenses include:
    • Financial losses related to fraud, identity theft or falsified tax returns
    • Costs to freeze or unfreeze a credit report
    • Expenses incurred due to purchasing or extending credit monitoring services
    • Other unreimbursed fees
  • Credit monitoring: All class members may submit to receive two years of Medical Shield Complete credit monitoring, which includes credit monitoring, dark web monitoring, real-time inquiry alerts and $1 million in identity theft insurance.

How to claim a class action rebate

To receive one or more of the settlement benefits, class members must submit a valid claim form by the deadline of Oct. 9, 2025. Individuals can file a claim online or print a PDF claim form to complete and mail to the settlement administrator.

  • Payments to approved claimants: Remaining settlement funds
