Consumers who purchased Gerber Good Start Gentle infant formula in Florida or New York between Oct. 10, 2011, and April 23, 2016, may qualify to claim up to $100 from a class action settlement.

Gerber Products Co. agreed to settle a class action lawsuit alleging it misleadingly stated the formula could reduce the risk of allergies.

Who can file a Gerber Good Start Gentle claim?

Consumers meet all of the following criteria:

  • They purchased Gerber Good Start Gentle infant formula in either Florida or New York.
  • The purchase occurred between Oct. 10, 2011, and April 23, 2016.
  • They bought the product for personal use (not for resale).
  • They did not receive the product through the WIC program.

There are two groups of class members:

  • Florida Settlement Class Members: Individuals who purchased Gerber Good Start Gentle infant formula in Florida during the class period.
  • New York Settlement Class Members: Individuals who purchased Gerber Good Start Gentle infant formula in New York during the class period.

Only one claim per household is allowed.

How much is the infant formula payout?

  • Florida purchasers without proof of purchase: $3.00 per unit up to five units ($15 maximum)
  • Florida purchasers with proof of purchase: $3.00 per unit up to 20 units ($60 max)
  • New York purchasers without proof of purchase: $4.00 per unit up to five units ($20 maximum)
  • New York purchasers with proof of purchase: $4.00 per unit up to 20 units ($80 max)

Class members can claim both proof and non-proof purchases.

How to claim a Gerber class action rebate

To receive a payment, class members can file a claim online or download and print the PDF claim form (it begins on Page 56) to fill out and mail to the settlement administrator. The deadline to submit a claim is Aug. 25, 2025.

Required proof and documentation

  • For online claims, class members must provide the notice ID and confirmation code found on the personalized notice they received via mail or email. Those who did not receive a notice may register to receive a notice ID and confirmation code online.
  • For claims without proof of purchase, class members must provide:
    • The name and birthdate of the infant for whom they purchased the formula
    • Their relationship to the infant
    • The state where the purchase was made
  • For claims with proof of purchase, class members must provide receipts, invoices, payment card records, etc. showing they purchased Gerber Good Start Gentle infant formula in Florida or New York during the class period.
  • Class members whose current address is not in Florida or New York must provide proof of residency during the class period.

  • Venmo
  • Zelle
  • Virtual prepaid card
  • Paper check mailed to the provided address)

Gerber Good Start Gentle settlement fund breakdown

The settlement fund covers:.

  • Settlement administration costs: Up to $750,000
  • Attorneys' fees and expenses: Up to $11,250,000
  • Service awards to class representatives: Up to $10,000 each ($20,000 total)
  • Payments to eligible class members: Paid separately and dependent on claims

When is the Gerber infant formula settlement payout date?

Payments will be issued approximately 90 days after the final approval hearing and once all claims are processed and any appeals are resolved.

Why is there a class action settlement?

The class action lawsuit alleged Gerber Products Co. made misleading statements when marketing, advertising and labeling its Good Start Gentle infant formula, specifically that the product could reduce the risk of allergies. Gerber denies any wrongdoing or liability but agreed to settle to avoid the risk, burden and expense of further litigation.
