Employees who worked as nonexempt employees for AT&T Mobility Services LLC in California between Sept. 21, 2022, and Sept. 3, 2025, may be eligible to receive a cash payment from a class action settlement.

AT&T Mobility Services LLC agreed to pay $1,837,500 to settle a class action lawsuit alleging it violated California labor laws, including claims for unpaid wages, missed meal and rest breaks, unreimbursed business expenses and other wage-and-hour violations. The settlement also resolves claims for civil penalties under the California Private Attorneys General Act.

Who are the class members?

The following individuals qualify as class members:

  • Anyone who worked for AT&T Mobility Services LLC in California as a nonexempt employee at any time from Sept. 21, 2022, to Sept. 3, 2025
    • This includes both current and former employees who meet the criteria above and worked at least one day in a workweek during the class period.

Additionally, there is a group of "aggrieved employees" for the purposes of the PAGA claim:

  • The settlement considers anyone who worked for AT&T Mobility Services LLC in California as a nonexempt employee during the same period (Sept. 21, 2022, to Sept. 3, 2025) as an aggrieved employee for PAGA purposes
  • This group includes anyone who worked at least one day in a pay period during the PAGA period.

The settlement administrator will use company records to identify eligible individuals and calculate their awards based on the number of workweeks and pay periods worked during the relevant periods.

The settlement will still consider those who opt out of the class settlement as aggrieved employees who release PAGA claims and send them a PAGA payment.

How much can class members get?

The settlement provides for two types of payments:

  • Individual class payments: The settlement administrator will distribute these payments to participating class members based on the number of workweeks they worked during the class period (Sept. 21, 2022, to Sept. 3, 2025)
  • Individual PAGA payments: The settlement administrator will distribute these payments to aggrieved employees based on the number of pay periods they worked during the PAGA period (same dates as above)

How are the payments calculated?

The settlement administrator will calculate individual class payments as follows:

  1. $1,837,500 (gross settlement fund) - court-approved deductions (such as attorneys' fees, service awards, administration costs and PAGA penalties) = net settlement fund
  2. The net settlement fund / the total number of workweeks all participating class members worked = value per workweek
  3. Value per workweek x number of workweeks the class member worked during the class period = each class member's payment

The settlement administrator will calculate individual PAGA ayments as follows:

  1. The PAGA penalties allocated to employees is $25,000 (25% of the total $100,000 PAGA penalty).
  2. $25,000 / total number of PAGA pay periods all aggrieved employees worked = value per pay period
  3. Value per pay period x number of pay periods the class member worked during the PAGA period = each aggrieved employee's payment

The settlement administrator provided each class member's estimated payment in the settlement notice they received. Class members can challenge the number of workweeks or pay periods credited to them if they believe they are incorrect.

No action needed to receive compensation

Class members do not need to submit a claim form to receive payment. The settlement administrator will automatically mail checks to eligible class members at the address on file. Those who moved should notify the administrator of their new address to ensure they receive payment.

$1.84 million settlement fund breakdown

The $1,837,500 settlement fund covers:

  • Settlement administration costs: Up to $35,000
  • Attorneys' fees: Up to $612,500
  • Attorneys' expenses: Up to $50,000
  • Service awards to class representatives: Up to $15,000 each for four plaintiffs (up to $60,000)
  • PAGA penalties: $100,000 (75% to the state and 25% to aggrieved employees)
  • Payments to eligible class members: Remainder of the fund

Important dates

  • Opt-out deadline: March 6, 2026
  • Deadline to challenge workweeks/pay periods: March 6, 2026
  • Final approval hearing: March 23, 2026

When is the AT&T Mobility Services LLC settlement payout date?

The settlement administrator will mail payments after the court grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged AT&T Mobility Services LLC violated California labor laws by failing to pay minimum and overtime wages, provide compliant meal and rest breaks, reimburse business expenses, issue accurate wage statements, pay wages when due and pay sick pay wages. The plaintiffs also sought civil penalties under PAGA and the Unfair Competition Law.

The company denied all allegations but agreed to settle to avoid the risks and costs of continued litigation.
