
Current and former patients who received a notice stating the July 2022 FMC Health data breach may have compromised their private information could qualify to submit a claim for up to $5,000 and data monitoring from a class action settlement. The data incident exposed the personal and protected health information of 266,540 adults and minor children.
FMC Services LLC, also known as FMC Health, agreed to pay $2.15 million to settle a class action lawsuit alleging it failed to adequately protect patient data during a cybersecurity incident in July 2022. The plaintiffs claimed negligence, breach of fiduciary duty, breach of implied contract and unjust enrichment.
Who can file a claim for a data breach payout?
Class members are individuals whose personally identifiable or personal health information the FMC Health July 2022 data breach compromised. This includes those who received a notice of the breach from FMC Services.
How much are settlement payments?
Class members have the following benefit options:
- Cash payment A – documented losses: Class members can claim up to $5,000 for documented, unreimbursed losses related to the data incident.
- Cash payment B – alternate cash: Class members who do not submit a documented losses claim can submit a claim to receive an estimated $75 cash payment. The settlement administrator will determine the final payment amount by the number of claims filed.
- Medical data monitoring: All adult class members can elect to receive two years of CyEx medical data monitoring, which includes credit monitoring, dark web scanning, security freezing assistance, victim assistance, $1,000,000 identity theft insurance with no deductible and access to fraud resolution agents.
- Minor data monitoring: All minor class members can elect to receive two years of CyEx minor monitoring, which includes Social Security number monitoring, dark web scanning, public record traces and access to fraud resolution agents.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof and claim information
- To submit a claim online, class members must provide the settlement claim ID from the settlement notice they received.
- Documented losses claims require supporting documentation, which may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges, communication with financial institutions and other proof of fraud or identity theft related to the data breach.

Settlement fund breakdown

When is the FMC Health data breach settlement payout date?
The settlement administrator will issue payments and medical and minor data monitoring information to approved class members no later than 75 days after the court grants final approval of the settlement.
Why did this class action settlement happen?
The class action lawsuit claimed FMC Services LLC, also known as FMC Health, experienced a data breach in July 2022 during which unauthorized parties accessed patients' sensitive personal and health information. The plaintiffs alleged FMC Services failed to adequately protect this information, resulting in claims of negligence, breach of fiduciary duty, breach of implied contract and unjust enrichment.
FMC Services denies the allegations but agreed to settle to avoid the risk and expense of continued litigation.
