First Choice Dental $1.23 Million Data Breach Settlement

If you received notice that your private information may have been involved in a data breach at First Choice Dental in October 2023, you may be eligible to claim up to $6,000 from a class action settlement.

FCDG Management LLC, doing business as First Choice Dental, has agreed to pay $1.23 million to settle a class action lawsuit. The lawsuit alleged that the company failed to adequately protect sensitive information, including names, dates of birth, Social Security numbers, passport numbers, driver’s license numbers, government identification numbers, credit and debit card numbers, financial account numbers, and health information.

First Choice Dental denies all allegations of wrongdoing or liability but agreed to settle to avoid the risks and costs of continued litigation.

Who can claim a payout?

According to the official settlement website, you are considered a class member and may file a claim if:

  • You are an individual in the United States whose private information was implicated in the data incident discovered by First Choice Dental in October 2023
  • You received notice of the data breach from First Choice Dental

How much can class members get?

Class members can claim one of two monetary compensation options, plus credit monitoring services:

  • Documented Economic Losses: Up to $6,000 per person for unreimbursed out-of-pocket expenses related to the data incident.
  • Alternative Cash Payment: Up to $50 as a flat cash payment.
  • Credit Monitoring: Three years of CyEx Medical Shield monitoring, including $1 million in identity theft protection insurance, can be claimed in addition to either monetary compensation option.

If the total amount claimed by class members, plus attorneys’ fees, administration costs, service awards, and information security improvements, exceeds the $1,225,000 settlement cap, payments will be reduced proportionally (pro rata).

How does the pro rata calculation work?

Suppose the total amount of valid claims and costs is $1,500,000, but the settlement cap is $1,225,000.

Each claimant’s payment would be multiplied by the ratio of the cap to the total claims: $1,225,000 ÷ $1,500,000 = 0.8167 (or about 81.7%)

So, if you were eligible for a $50 payment, you would receive $40.83 ($50 × 81.67%).

How to claim a data breach payout

Class members must submit a claim form by Jan. 28, 2026.

Claims can be filed in two ways:

Is documentation required to submit a claim?

Documentation is required if you are claiming documented economic losses. No documentation is needed for the alternative cash payment option.

  • Documented Economic Losses: You must provide documentation showing the loss or expense and that it was not reimbursed by another source. Eligible expenses include monetary loss from fraud or identity theft, professional fees (such as attorneys’ fees, accountants’ fees, and credit repair services), costs for freezing or unfreezing credit, credit monitoring costs incurred after the breach notice, and miscellaneous expenses like notary, postage, copying, mileage, and long-distance phone charges. Claimants cannot be reimbursed for expenses already covered by another source.
  • Alternative Cash Payment: No documentation is required; you only need to attest to your eligibility.

What are the payout options?

Class members can choose how they receive their compensation:

  • Payment via check or electronic payment (as specified on the claim form)
  • Credit monitoring activation code sent by email or mail

$1.23 million settlement fund

The settlement fund of $1,225,000 will cover all monetary compensation to class members, attorneys’ fees, administration costs, service awards, and information security improvements.

Breakdown:

  • Settlement administration costs: TBD
  • Attorneys' fees: $475,000
  • Service awards to class representatives: $22,000 (there are at least 11 named class representatives receiving $2,000 each)
  • Payments to class members: The remainder of the fund after fees, costs, and service awards
  • Information security improvements: $225,000

Important dates

  • Fairness hearing: Jan. 12, 2026
  • Deadline to file a claim: Jan. 28, 2026
  • Deadline to opt out: Dec. 29, 2025

When is the First Choice Dental settlement payout date?

The court will hold a final fairness hearing on Jan. 12, 2026, to decide whether to approve the settlement. If the settlement is approved and no appeals are filed, payments and credit monitoring instructions will be distributed to eligible claimants.

This is expected to occur several months after the fairness hearing.
