
Consumers who received notice that their private information may have been involved in a data breach at First Choice Dental in October 2023 may be eligible to claim up to $6,000 from a class action settlement.
FCDG Management LLC, doing business as First Choice Dental, agreed to pay $1.23 million to settle a class action lawsuit alleging it failed to adequately protect sensitive information, including:
- Names
- Dates of birth
- Social Security numbers
- Passport numbers
- Driver’s license numbers
- Government identification numbers
- Credit and debit card numbers
- Financial account numbers
- Health information
First Choice Dental denies all allegations of wrongdoing or liability but agreed to settle to avoid the risks and costs of continued litigation.
Who can claim a payout?
Class members must meet the following criteria:
- They are an individual in the United States twhose private information he data incident discovered by First Choice Dental in October 2023 affected.
- They received notice of the data breach from First Choice Dental.
How much can class members get?
Class members can claim one of two monetary compensation options plus credit monitoring services:
- Documented economic losses: Up to $6,000 per person for unreimbursed out-of-pocket expenses related to the data incident
- Alternative cash payment: Up to $50 as a flat cash payment
- Credit monitoring: Three years of CyEx Medical Shield monitoring, including $1 million in identity theft protection insurance
If the total amount class members claim, plus attorneys’ fees, administration costs, service awards, and information security improvements, exceeds the $1,225,000 settlement cap, the settlement administrator will reduce payments proportionally.
How to claim a data breach payout
Class members can file claims two ways:
- Online: Submit the online claim form to file electronically
- By mail: Download, print and complete the PDF claim form and mail it to the settlement administrator

Are proof or documentation required to submit a claim?
- Documented economic losses: Class members must provide documentation showing the loss or expense and that another source did not reimburse it. Eligible expenses include
- Monetary loss from fraud or identity theft
- Professional fees (such as attorneys’ fees, accountants’ fees and credit repair services)
- Costs for freezing or unfreezing credit
- Credit monitoring costs incurred after the breach notice
- Miscellaneous expenses like notary, postage, copying and mileage
- Alternative cash payment or credit monitoring: No documentation is required.
What are the payout options?
- Paper check
- Electronic payment
The settlement administrator will mail or email a credit monitoring activation code to valid claimants who choose this option.
$1.23 million settlement fund
The $1,225,000 settlement fund includes.
- Settlement administration costs: To be determined
- Attorneys' fees and costs: $475,000
- Service awards to class representatives: $22,000 total (11 named class representatives receiving $2,000 each)
- Information security improvements: $225,000
- Payments to eligible class members: The remainder of the fund

When is the First Choice Dental settlement payout date?
If the court approves the settlement and no class members file appeals, the settlement administrator will then issue payments and credit monitoring instructions to eligible claimants. This is expected to occur several months after the fairness hearing.
