Individuals whose personal information the March 2024 Evening Post Publishing data breach exposed may be eligible to claim up to $3,060 plus credit monitoring from a class action settlement.

Evening Post Publishing Inc. agreed to pay $500,000 to resolve a class action lawsuit related to a targeted cyberattack that occurred in March 2024. The lawsuit alleges the company failed to adequately protect private information, including names, passport numbers, Social Security numbers, financial account details, credit card information and driver’s license numbers.

Who can file a claim?

The class includes all individuals residing in the United States whose personally identifiable information the March 2024 data incident involving Evening Post Publishing Inc. compromised. This includes current and former employees, as well as any other individuals who received a data breach notice on or about Aug. 21, 2024.

The compromised information may include:

  • Names
  • Passport numbers
  • Social Security numbers
  • Financial account information
  • Credit card information
  • Driver’s license numbers

How much can class members get?

The settlement offers several forms of compensation, including credit monitoring and cash payments.

  • Reimbursement for out-of-pocket losses: Class members may claim up to $3,000 for documented losses directly resulting from the data incident that occurred between March 13, 2024, and June 24, 2026. Eligible expenses include losses due to identity theft or fraud, fees for credit reports or monitoring, costs to replace IDs and postage for contacting banks. Class members must provide documentation, such as bank statements.
  • Reimbursement for lost time: Class members who spent time dealing with the data breach can claim up to three hours of lost time at $20 per hour for a maximum of $60. This covers activities like changing passwords, investigating suspicious activity or researching the incident.
  • Alternative cash payment: Instead of claiming out-of-pocket losses or lost time, class members may opt for a one-time $40 cash payment. They do not need to submit documentation for this option.
  • Credit monitoring and identity theft protection. All class members are eligible to enroll in two years of CyEx Financial Shield Complete. This benefit comes with $1 million in identity theft insurance and includes real time monitoring of their credit file, dark web scanning and comprehensive public records monitoring.

The settlement caps cash payments at $500,000. If the total value of valid claims exceeds this amount, the settlement administrator will reduce payments proportionally.

How to claim a settlement payment

Class members can file a claim online or download and print a PDF claim form, complete it and mail or email it to the settlement administrator. Claimants may also request a paper copy of the claim form by calling 833-386-6473 or emailing the settlement administrator. The claim deadline is June 24, 2026.

What proof or documentation is necessary to submit a claim?

  • To submit an online claim form, class members must log in with the unique ID and PIN located on the settlement notice they received. Those who are unable to locate their ID & PIN should contact the settlement administrator by emailing info@EveningPostDataSettlement.com and providing their full name and mailing address.
  • To submit an out-of-pocket losses claim, class members must provide proof, such as bank statements, receipts or other documentation showing the data incident caused the expenses. Self-prepared notes are not sufficient alone, but the class member may use them to support other documentation.
  • To submit a lost time claim, class members must attest to the time spent but do not need to provide additional documentation.
  • To submit an alternative cash payment or credit monitoring claim, class members must select the appropriate option on the claim form. They do not need to provide documentation.
