Splunk, Cisco Systems $1.2M Washington Job Listing Settlement

Individuals who applied for a job with Splunk LLC or Cisco Systems Inc. in Washington state between Jan. 1, 2023, and July 26, 2025, in which the job posting did not include pay or benefits information may be eligible to claim an estimated $1,673.71 from a class action settlement.

Splunk LLC and Cisco Systems Inc. agreed to pay up to $1.22 million to settle a class action lawsuit alleging they failed to include required wage, salary and benefits information in job postings for positions in Washington state in violation of Washington’s Equal Pay and Opportunities Act. There are an estimated 488 class members.

Who can file a claim?

Individuals are considered class members if they meet all of the following criteria:

  • They applied for a job with Splunk LLC or Cisco Systems Inc. between Jan. 1, 2023, and July 26, 2025.
  • The job was either a remote position listing multiple cities or states (including Seattle and/or Washington) or an opening in the state of Washington.
  • The job posting did not disclose a wage scale or salary range and/or a general description of benefits or other compensation.

The settlement administrator identified eligible class members using company records. Individuals who received a notice about the settlement are likely included.

How much is the class action payout?

Each class member who submits a valid claim form is eligible to receive an equal share of the net settlement fund after deducting attorneys’ fees and costs, a service award to the class representative, and settlement administration costs. The estimated payment per class member is $1,673.71, but the actual amount may vary depending on the number of valid claims submitted.

The settlement fund is structured as follows:

  • If 244 or fewer class members submit valid claims (50% or less of the 488 identified class members), the settlement administrator will distribute the minimum settlement fund of $812,448.32 equally among those claimants.
  • For each additional valid claimant above 244, the administrator will increase the fund by $1,670.28 up to a maximum of $1,220,000.
  • No individual payment will exceed $5,000. If class members' calculated payments would be higher, the administrator will donate the excess to the Legal Foundation of Washington and the Washington Employment Lawyer’s Association.

How to claim a settlement payment

Class members can file a claim online or download, print and complete a PDF claim form (Page 29 of the settlement agreement) and mail or email it to the settlement administrator.

Class members must submit their claim online or postmark it by May 25, 2026.

If a class member's contact information changes, they should notify the settlement administrator to ensure they receive payment.

Required information

To submit an online claim, class members must provide the notice ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator at info@EPOASettlementSLLC.com or 888-369-3780 and provide their full name and mailing address.

Payout options

The settlement administrator will mail checks to the addresses class members provide on their claim forms. Class members must cash their checks within 180 days of issuance. After that time, the settlement administrator will send uncashed funds to the state of Washington as unclaimed property.

$1.22 million settlement fund breakdown

The $1,220,000 settlement fund includes:

  • Settlement administration costs: Up to $20,000
  • Attorneys' fees: $359,900
  • Attorneys' expenses: $5,000
  • Service award to class representative: $20,000
  • Payments to approved class members: The remainder of the fund

When is the Milito v. Splunk LLC, et al. payout date?

The settlement administrator will mail payments to eligible class members after the court resolves any appeals and grants final approval of the settlement.

The class action lawsuit alleged Splunk LLC and Cisco Systems Inc. violated Washington’s Equal Pay and Opportunities Act by not including pay and benefits information in job postings for positions in Washington.

The companies denied any wrongdoing but agreed to settle to avoid the uncertainty, risk and expense of ongoing litigation.
