Elanco Animal Health, Inc.; Bayer Healthcare LLC; Bayer Healthcare Animal Health, Inc.; Bayer AG; and Bayer Corporation have agreed to pay $15,000,000 to settle a class action lawsuit for alleged false labeling and marketing of the Seresto Products. The lawsuit claims that the products were marketed to provide 8 months of protection from fleas and ticks while failing to disclose health risks to pets. This settlement benefits individuals who purchased Seresto Products for personal use on or before July 8, 2024.

Who Benefits?: Individuals in the United States, its territories, and/or the District of Columbia who purchased Seresto Products for personal use and not for resale on or before July 8, 2024.

How much can I get?: Settlement Class Members with valid proof of purchase can receive $13.00 per collar. Without valid proof, the amount is $13.00 per collar per pet, with a maximum of $26.00 per pet. Additional reimbursements are available for economic injuries, medical treatment costs, and pet death.

Can I Claim an Award?

The Settlement Class includes all persons in the United States, its territories, and/or the District of Columbia who purchased, for personal use and not for resale, any Seresto Product on or before July 8, 2024. This means that if you bought a Seresto flea and tick collar for your pet and did not resell it, you are likely eligible to claim an award from this settlement.

To be part of the Settlement Class, you must have purchased the product on or before July 8, 2024. The settlement applies to all such purchases, regardless of the number of collars bought. If you meet these criteria, you are entitled to submit a claim for a cash award.

  • Settlement Class Members with valid proof of purchase can receive $13.00 per collar.
  • Settlement Class Members without valid proof of purchase can receive $13.00 per collar per pet, with a maximum of $26.00 per pet.

Who is Excluded?

The Settlement Class does not include Defendants and their respective subsidiaries and affiliates, members, employees, officers, directors, agents, and representatives and their family members. It also excludes Class Counsel, the judges who have presided over the litigation, local, municipal, state, and federal governmental agencies, and all persons who have timely elected to become Opt-Outs from the Settlement Class in accordance with the Court’s Orders.

What Awards Can Class Members Claim?

Settlement Class Members can claim various awards based on their circumstances and the proof they provide. The settlement offers different tiers of compensation to ensure that all eligible members receive appropriate reimbursement.

The awards are structured to cover different types of claims, including collar reimbursement, injury reimbursement, and pet death reimbursement. Each category has specific requirements and limits, ensuring fair distribution of the settlement fund.

  • Collar Reimbursement: Settlement Class Members with valid proof of purchase can receive $13.00 per collar. There is no limit on the number of collars that can be reimbursed with valid proof.
  • Injury Reimbursement: Members can choose between a $25 payment for economic injury (with a declaration) or 100% reimbursement of out-of-pocket, non-reimbursed medical treatment costs (with documentation).
  • Pet Death Reimbursement: Members can receive a $300 payment for the death of a pet (with a declaration) and 100% reimbursement of medical treatment and burial/cremation costs (with documentation).

Is Proof Required to Claim the Reward?

Yes, proof is required to claim the reward. The type of proof needed depends on the specific award being claimed. Providing valid proof of purchase can increase the amount of reimbursement you are eligible to receive.

  • Injury Reimbursement: A declaration for economic injury or documentation for medical treatment costs.
  • Pet Death Reimbursement: A declaration for pet death and documentation for medical and burial/cremation costs.

How to Claim Your Award

To claim your award, you need to submit a claim form. You can do this online from the Official Claim Form. The form must be completed and submitted by July 23, 2024.

If you prefer to submit a paper claim form, you can download it from the official settlement website and mail it to the Claims Administrator at the address provided. Ensure that your claim form is postmarked by July 23, 2024.

$15,000,000 Settlement

The settlement amount agreed upon by the Defendants is $15,000,000. This fund will be used to pay Cash Awards, Notice and Administration Costs, Attorneys’ Fees and Costs, and Service Awards.

The settlement amount was determined to cover all eligible claims and associated costs. If the number of claims exceeds the available funds, the settlement amount may be prorated to ensure fair distribution among all claimants.

Why is There a Class Action Settlement?

The class action settlement addresses allegations that the Defendants falsely labeled and marketed the Seresto Products, claiming they provided 8 months of protection from fleas and ticks while failing to disclose health risks to pets. The Defendants deny these allegations but have agreed to the settlement to avoid the costs and risks associated with continuing the case.

The next steps include the Fairness Hearing scheduled for December 4, 2024, where the Court will decide whether to approve the settlement. If approved, the settlement funds will be distributed to eligible claimants who have submitted valid claims.
