Employees who used a WorkEasy, EasyClocking, EasyWorkforce, or TimeLogix fingerprint timeclock in Illinois between June 24, 2016, and Aug. 15, 2023, may be eligible to submit a claim for a cash payment of up to $750 from a class action settlement. The settlement includes approximately 21,915 current and former employees who utilized the timeclocks.

WorkEasy Software LLC, formerly known as EasyWorkforce Software LLC, has agreed to pay $1.69 million to resolve a class action lawsuit. The plaintiffs claimed that the company violated the Illinois Biometric Information Privacy Act (BIPA) by collecting, storing, and disclosing biometric data, such as employee fingerprints, without proper consent and security measures.

Who is eligible for a settlement payment?

All class members must meet the following criteria:

  • They used a WorkEasy, EasyClocking, EasyWorkforce, or TimeLogix fingerprint timeclock to clock in or out at a job in Illinois.
  • They used the device at any time between June 24, 2016, and Aug. 15, 2023.

The settlement has two groups of class members:

  • Class: Individuals who used one of the fingerprint timeclocks in Illinois between June 24, 2016, to Aug. 15, 2023.
  • Subclass: Individuals who used one of the fingerprint timeclocks in Illinois on or before April 30, 2022.

How much is the class action payout?

Class members can submit to receive:

  • Subclass members (used the device on or before April 30, 2022): These class members can submit to receive a cash payment between $225 and $750.
  • Other class members (started using the device after April 30, 2022): These class members can submit to receive a cash payment between $160 and $500.

Final payment amounts will be determined by the total number of valid claims filed. Payments will be issued over a period of five years.

To receive a settlement payment, class members can file a claim online or print the PDF claim form and mail it to the settlement administrator.

$1.69 million BIPA settlement fund

The $1,685,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $561,667
  • Attorneys' expenses: $253,376.31
  • Service award to class representative: $10,000
  • Payments to approved claimants: Remaining settlement funds

When is the EasyWorkforce BIPA settlement payout date?

The first round of payments will be issued to eligible class members approximately 73 days after the court grants final approval of the settlement. Additional payments will be made annually for five years.

Why was there a class action settlement?

This class action lawsuit was filed because WorkEasy was accused of violating the Illinois Biometric Information Privacy Act (BIPA) by collecting and storing fingerprint data from timeclocks without proper consent and without adequate security measures.
