Individuals living in the United States whose private information was accessed or obtained during the December 2023 DataMaxx data breach, may be eligible to submit a claim for up to $2,500 from a class action settlement. The data breach compromised personal and protected health information belonging to 61,985 people.

DataMaxx Applied Technologies Inc. has agreed to pay $465,000 to settle a class action lawsuit that was filed after a cybersecurity incident occurred in December 2023. The class action claimed that DataMaxx failed to adequately safeguard personal information, including names, Social Security numbers, driver’s license numbers and medical information, which may have been accessed by unauthorized parties.

Who can file a data breach claim?

Class members are individuals residing in the United States whose private information was accessed and/or acquired by an unauthorized party as a result of the December 2023 DataMaxx data incident.

How much will the settlement payout be?

Class members have the following benefit options:

Credit monitoring: All class members can elect to receive three years of one-bureau credit monitoring services. This includes real-time credit file monitoring, dark web scanning, comprehensive public records monitoring and $1 million in identity theft insurance.

  • Cash payment A – Documented losses: Class members can claim up to $2,500 for documented out-of-pocket losses that occurred between Dec. 1, 2023, and April 6, 2026 and are traceable to the data breach. Eligible expenses include monetary losses from identity theft or fraud, fees for credit reports, credit monitoring, or freezing/unfreezing credit, costs to replace IDs and postage for contacting banks by mail.
  • Cash payment B – Alternate cash: Class members that do not submit a documented losses claim can submit a claim for a one-time cash payment of $50.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or download and print the PDF claim form and mail it to the settlement administrator.

The claim deadline is April 6, 2026.

Required proof and claim information

  • Unique ID and PIN from settlement notice required to submit a claim online.
  • Documented losses claims require proof, which may include receipts, invoices, bank or credit card statements showing fees or fraudulent charges, police report and other correspondence regarding identity theft and fraud.

When is the DataMaxx data breach settlement payout date?

Payments and credit monitoring codes will be issued to approved claimants approximately 90 days after the settlement is granted final approval.

Why did this class action settlement happen?

The class action lawsuit alleged that DataMaxx Applied Technologies Inc. failed to adequately protect private information during a cybersecurity incident in December 2023. Plaintiffs claimed that personal data, including names, Social Security numbers, driver’s license numbers and medical information, may have been accessed by unauthorized parties.

DataMaxx denies the allegations and maintains that there is no evidence of misuse of the information. Both parties agreed to settle to avoid the expense and uncertainties of continued litigation.
