Costa Del Mar $21.75M Sunglasses Repair Fee Settlement
Costa Del Mar $21.75M Sunglasses Repair Fee Settlement

Florida residents who purchased nonprescription, non-promotional Costa sunglasses between July 28, 2013, and Jan. 31, 2018, or paid a repair fee to Costa between July 28, 2012, and Jan. 26, 2025, for sunglasses bought on or before Jan. 31, 2018, may be eligible to submit a claim for a cash payment from a class action settlement.

Costa Del Mar Inc. agreed to pay $21.75 million to settle a class action lawsuit alleging it misrepresented its “nominal fee” repair promise and charged consumers more than a nominal fee to repair sunglasses damaged by accident, normal wear and tear, or misuse. The plaintiff also claimed Costa failed to disclose these repair charges at the time of purchase, on its website or over the phone before customers mailed in their sunglasses at their own expense.

There is a separate Costa Del Mar settlement for non-Florida residents and another over warranty fees.

Who qualifies for a Costa sunglasses settlement payout?

There are two settlement classes:

  • Purchase class: The purchase class includes Florida citizens who purchased nonprescription, nonpromotional Costa sunglasses for personal use between July 28, 2013, and Jan. 31, 2018.
  • Repair class: The repair class includes Florida citizens who purchased nonprescription, nonpromotional Costa sunglasses for personal use on or before Jan. 31, 2018, and whom Costa charged a fee between July 28, 2012, and Jan. 26, 2025, to replace damaged components of their sunglasses.

Class members who meet the criteria for both the purchase class and the repair class are only eligible to participate as a member of the repair class and cannot submit a secondary purchase class claim.

Costa denied any wrongdoing but agreed to settle to avoid the expense and uncertainty of further litigation.
