
Individuals who reside in the United States and received notice of the Continental Café Holdings LLC data incident may be eligible to claim up to $700 from a class action settlement.
Continental Café Holdings LLC agreed to resolve a class action lawsuit alleging a cybersecurity event exposed individuals’ private information.
Who can file a claim?
The settlement considers individuals class members if all of the following apply:
- They received a written notice from Continental Café Holdings LLC dated Nov. 12, 2024, informing them the data incident compromised their personal information.
- They reside in the United States.
- They are not a party to an arbitration agreement with Continental Café Holdings LLC implemented on March 14, 2019, and/or July 18, 2023.
How much can class members get?
Class members can claim one or more of the following benefits:
- Reimbursement for out-of-pocket losses: Class members who experienced actual, documented, unreimbursed expenses as a result of the data incident may claim up to $700. Eligible expenses include costs to address identity theft or fraud, preventive costs like credit monitoring or freezing credit reports, and other documented losses not reimbursed elsewhere.
- Alternative cash payment: Class members who do not have out-of-pocket losses or do not wish to submit documentation can claim a flat payment of up to $50.
- Credit monitoring: All class members may claim three years of credit monitoring and identity theft protection services regardless.
How to claim a settlement payment
Class members can file a claim online or download and print a PDF claim form, fill it out and mail it to the settlement administrator.

What proof or documentation is required to submit a claim?
- To file an online claim form, class members must log in with the login ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@ContinentalCafeDataIncident.com and providing their full name and mailing address.
- To file a claim for out-of-pocket losses, class members must provide third-party documentation, such as bank statements, receipts, invoices or other records, that show the expenses and their relation to the data incident. Self-prepared documentation alone is not sufficient.
- To file a claim for the alternative cash payment or credit monitoring, class members need only select the appropriate option on the claim form.

Settlement fund breakdown
The settlement fund will cover:
- Settlement administration costs: To be determined
- Attorneys' fees and expenses: $130,000
- Service award to class representative: $2,500
- Credit monitoring costs: Determined by number of valid claims for this option
- Payments to eligible class members: Remainder of the fund

When is the Continental Café Holdings data breach payout date?
The settlement administrator will make payments after the court resolves any appeals and grants final approval of the settlement.
Why did this class action settlement happen?
The class action lawsuit claimed Continental Café Holdings LLC experienced a cybersecurity event on Oct. 18, 2024, that affected individuals’ private information. The plaintiffs alleged that Continental Café Holdings LLC was responsible for the data incident.
The company denies any wrongdoing, but both sides agreed to settle to avoid the costs and uncertainty of litigation and to provide timely benefits to those affected.
