Individuals who received at least two text messages from Colony Ridge Development, advertising Terrenos Santa Fe, on their personal cell phone between June 27, 2020, and May 7, 2025, may be eligible to submit a claim to receive between $1,000 and $2,000 from a class action settlement.

Colony Ridge Development has agreed to pay $1,994,123 to resolve a class action lawsuit that alleged the company sent non-emergency advertising and marketing text messages advertising Terrenos Santa Fe to consumers without first obtaining written consent. The lawsuit, filed under the Telephone Consumer Protection Act (TCPA), affects an estimated 71,616 individuals nationwide.

Who is eligible for a class action payout?

Class members must meet the following criteria:

  • They received more than one text message within a 12-month period from Colony Ridge Development, or its business partners, promoting their goods or services, which included Terrenos Santa Fe.
  • Their cell phone number was registered with the National Do Not Call Registry for at least 30 days before receiving at least two of these text messages within the 12-month period.
  • The text messages were sent and received between June 27, 2020, and May 7, 2025.
  • Their phone number is included on list of numbers identified by Colony Ridge as potentially affected.

How much s the TCPA settlement payment?

Pro rata cash payment: Each approved claimant will receive an equal share of the net settlement fund. The estimated payment per person ranges from $1,000 to $2,000. Final payment amount will be determined by the number of valid claims filed.

How to claim a class action rebate

To receive a settlement payment, a claim must be submitted by the deadline of Dec. 15, 2025. Class members can submit the online claim form or complete the claim form received with their settlement postcard notice and mail it to the settlement administrator.

Why is there a class action settlement?
