You are a class member if:

  • You reside in the United States and received a notification from Coastal Orthopedics informing you that your private information may have been accessed or acquired due to a June 2023 data incident
  • You received a notice of eligibility for this data breach settlement.

How much is the settlement payment?

Class members can claim one or more of the following benefit options:

  • Reimbursement of documented monetary losses: Class members can submit for up to $10,000 per person for out-of-pocket expenses that are fairly traceable to the data incident. Expenses include unreimbursed costs due to identity theft or fraud, credit monitoring fees including freezing and unfreezing, bank or credit card fees, and other charges.
  • Credit monitoring and identity restoration services: All class members can elect to receive two years of one-bureau credit monitoring, including $1 million in fraud and identity theft insurance and medical information monitoring.
  • Pro rata cash payment: All class members can also claim a pro rata cash payment, amount determined by the number of claims filed.
    • Group 1, class members whose Social Security number was compromised in the breach, will receive a payment amount that is three times the amount of Group 2 members, which consists of class members that did not have their SSNs compromised.

How to claim a class action rebate

To receive a data breach settlement payment or credit monitoring, class members must submit a claim form. You can file a claim online or download the PDF claim form and mail it to the settlement administrator by the August 13, 2025 deadline.

Required proof and information

$1.4 Million data breach settlement fund

The settlement fund of $1,403,646.30 will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $467,882.10
  • Attorneys' expenses: Not to exceed $25,000
  • Service awards to class representatives: $2,500 each for three representatives, $7,500 total
  • Credit monitoring and identity restoration services: Cost determined by number of claims filed
  • Payments to approved claimants: Remaining settlement funds

When is the Coastal Orthopedics data breach settlement payout date?
