Aion Management $1.1M Apartment Fees Class Action Settlement

Individuals who signed a lease at a Virginia apartment complex managed by AION Management between Oct. 10, 2023, and Nov. 1, 2025, may qualify to receive approximately $141 from a class action settlement. The settlement class includes approximately 5,508 current and former lessees.

Aion Management LLC and AP 11 North LLC agreed to pay $1,197,442 to settle a class action lawsuit. The complaint alleged the companies violated the Virginia Consumer Protection Act and the Virginia Residential Landlord Tenant Act by assessing and collecting certain fees, specifically, pest control, trash removal, community amenity and administrative billing fees, on leases at their Virginia properties.

Who are the class members?

Class members must meet the following criteria:

  • They executed a lease at any of the following Aion-managed apartment complexes in Virginia:
    • Pointe at River City
    • James River Pointe
    • Chesterfield Flats
    • Reserves at Tidewater
    • Harborstone Apartments
    • Chesapeake Pointe
  • They paid or were obligated to pay any of the qualifying disputed fees between Oct. 10, 2023, and Nov. 1, 2025:
    • Pest control fee
    • Trash removal fee
    • Community amenity fee
    • Administrative billing fee

How much are settlement payments?

Cash payment: Eligible class members will receive a cash payment of approximately $141.

No claim form required

Class members do not need to file a claim to receive a settlement payment. They can update their address information online using the notice ID and PIN from their settlement notice.

Settlement fund breakdown

The $1,197,442 settlement fund will include:

  • Settlement administration costs: $25,000
  • Attorneys’ fees and expenses: Up to $388,314
  • Service award to class representative: Up to $7,500
  • Payments to eligible class members: $776,628

  • Exclusion deadline: Sept. 8, 2026
  • Final fairness hearing: Oct. 21, 2026

When is the Aion Management apartment fees settlement payout date?

The settlement administrator will issue payments to eligible class members approximately 51 days after the court grants final approval of the settlement.

Why is there a class action settlement?

This class action lawsuit alleged Aion Management LLC and AP 11 North LLC violated the Virginia Consumer Protection Act and the Virginia Residential Landlord Tenant Act by assessing and collecting certain fees that Virginia law does not permit. The disputed fees included pest control, trash removal, community amenity and administrative billing fees.

The companies denied any wrongdoing but agreed to settle the case to avoid the expense and risk of further litigation.
