Individuals in the United States whose private information the Antigo Construction Inc. data breach that occurred from June 1-6, 2025, compromised may be eligible to claim a cash payment and free credit monitoring from a class action settlement.

Antigo Construction, along with Badger State Highway Equipment Inc., Antigo International Inc. and Antigo MHB Breakers Ltd, agreed to settle a class action lawsuit regarding a data breach that exposed sensitive personal information. The information included names, Social Security numbers, driver's license numbers, financial account numbers and health insurance information.

Who can file a claim?

Class members are all individuals whose private information the June 1-6, 2026, Antigo Construction data breach exposed, including those who received notice of the incident.

How much can class members get?

The settlement provides two options for cash payments, as well as free credit monitoring.

  • Reimbursement for documented out-of-pocket losses and lost time: Eligible expenses include credit report fees, credit freeze fees, card replacement fees, late fees, over-limit fees, interest and fees on payday loans, bank or credit card fees, postage, mileage, incidental expenses and the cost of credit monitoring or identity theft insurance purchased before the settlement’s effective date. In addition, class members can claim compensation for lost time at $25 per hour for up to five hours for a maximum of $125. The total amount a class member can claim for both out-of-pocket losses and lost time is $3,000 per person. The settlement caps the total pool for these claims at $200,000. If valid claims exceed this amount, the settlement administrator will reduce payments on a pro rata basis.
  • Alternative cash payment: Class members who do not submit documentation for losses or lost time can elect to receive a flat $100 cash payment.
  • Credit monitoring: All class members automatically receive an activation code for two years of free three-bureau credit monitoring regardless of whether they submit a claim for monetary compensation.

How to claim a settlement payment

Class members must submit an online claim form or print and complete the PDF claim form and mail it to the settlement administrator.

What proof or documentation is necessary to submit a claim?

  • For documented out-of-pocket losses, claimants must provide documentation demonstrating they actually incurred the costs or expenditures and that they are fairly traceable to the Antigo Construction data breach. Acceptable documentation includes receipts, statements or other proof of payment. Self-prepared documents alone are not sufficient.
  • For lost time, claimants must attest to the number of hours spent and provide a brief description of the actions taken in response to the data breach.
  • For the alternative cash payment, claimants do not need to provide documentation. They just need to select this option on the claim form.
  • For online claims, claimants must provide the Notice ID they received with their settlement notice.
