Individuals who received notice that the October 2024 data breach at Alpine Ear, Nose, & Throat potentially exposed their personal information may be eligible to claim up to $5,080 plus credit monitoring from a class action settlement.

Alpine Ear, Nose & Throat PLLC agreed to settle a class action lawsuit claiming a targeted third-party cyberattack on its network exposed files containing personally identifiable and health information.

Who can file a claim?

Class members must meet the following criteria:

  • They reside in the United States.
  • The October 2024 data incident at Alpine Ear, Nose & Throat PLLC may have involved their private information.
  • They received notice of the data incident, including notice of the settlement.

How much can class members receive?

  • Cash payment A–documented losses: Class members who experienced actual, documented out-of-pocket losses between between Oct. 9, 2024, and July 23, 2026, due to the data incident may claim up to $5,000. Eligible expenses include:
    • Losses from identity theft or fraud
    • Fees for credit reports, credit monitoring or freezing/unfreezing credit
    • Costs to replace IDs
    • Postage for contacting banks by mail
  • Cash payment B–lost time: Class members who spent time dealing with the data incident may claim up to four hours of lost time at $20 per hour for a maximum of $80. They must briefly explain how they spent their time. Eligible activities include:
    • Changing passwords
    • Investigating suspicious activity in their accounts
    • Researching the data incident
  • Cash payment C–alternate cash: Instead of claiming for documented losses or lost time, class members may opt for a one-time $50 cash payment.
  • Credit monitoring: All class members can claim two years of CyEx Medical Shield Complete, which includes medical and credit monitoring, $1 million in medical identity theft insurance and fraud resolution assistance.

If the total amount all class members claim exceeds the available funds, the settlement administrator may reduce payments on a pro rata basis.

How to claim a data breach payment

Class members can file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator. They may also request a paper claim form by calling 833-386-6505 or emailing info@AENTDataSettlement.com.

What proof or documentation is necessary to submit a claim?

  • For online claims, class members must log in with the login ID and PIN located on the top of the notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@AENTDataSettlement.com and providing their full name and mailing address.
  • For cash payment A–documented losses, class members must provide receipts or other proof of out-of-pocket expenses. Personal declarations alone are not sufficient, but the class member may include them for context.
  • For cash payment B–lost time, class members must briefly describe how they spent the time.
  • For cash payment C–alternate cash or credit monitoring, class members do not need to provide documentation but must select the appropriate option on the claim form.

Settlement fund breakdown

The settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys' fees and costs: Up to $330,000
  • Service award to class representative: $2,500
  • Credit monitoring costs: Dependent on number of claims for this option
  • Payments to approved class members: The remainder of the fund

When is the Alpine Ear, Nose & Throat data breach settlement payout date?

The settlement administrator will distribute cash payments and credit monitoring activation codes no later than 60 days after the court resolves any appeals and grants final approval to the settlement.
