
Employees who worked as health care workers for Advanced Care Staffing LLC or Priority Care Staffing LLC between Sept. 16, 2012, and June 11, 2025, and entered the United States through the foreign nurse recruitment program may be eligible to claim an estimated $1,200 from a class action settlement.
Advanced Care Staffing LLC and Priority Care Staffing LLC agreed to pay $1.19 million to settle a class action lawsuit alleging they unlawfully required health care workers to pay penalties if they left before the end of their contracts. The settlement also addresses related claims about contract terms that may have forced employees to work longer for lower pay.
Who are the class members?
Class members are individuals who meet the following criteria:
- They worked as a health care worker for Advanced Care Staffing LLC or Priority Care Staffing LLC.
- They entered the United States through the companies’ foreign nurse recruitment program.
- They entered into a contract with either company between Sept. 16, 2012, and June 11, 2025.
If a class member received a postcard or email notice, the companies’ records indicate they are a class member.
There are two main groups within the settlement:
- Settlement class: All health care workers who meet the above criteria
- Settlement collective: Health care workers who worked for either company between June 11, 2022, and June 11, 2025, and who submit a Fair Labor Standards Act consent and release form. These class members are eligible for an additional payment of approximately 10% more than the base payment.
How much can class members get?
Class members who submit valid claims will receive an estimated payment of $1,200. The actual amount each person receives depends on how long they worked for the companies—the longer the employment, the higher the payment. Those who join the settlement collective by submitting the FLSA consent and release form will receive about 10% more.
Class members who previously paid money to the companies for leaving before their contract ended will receive or may have already received that money back through the New York Attorney General and U.S. Department of Labor. The total those agencies distributed is $663,668.66. The administrator will distribute the remaining $526,331.34 through this settlement after deducting attorneys’ fees, costs and service awards.
Those who currently owe money to the companies for resigning before their contract ended will not have to pay it. For current employees as of June 11, 2025, future resignations for "good reason" will not require repayment, and if they leave without "good reason," the amount they owe will be capped at $5,000.
How to claim an additional payment
Most class members do not need to file a claim to receive their payment. Those who are eligible for the settlement collective (those who worked between June 11, 2022, and June 11, 2025) must submit an FLSA consent and release form to receive the additional 10% payment. They can file a claim online or download, print and complete the PDF claim form (Page 50 of the settlement agreement) to mail in.

Required information
To file an online claim, class members must provide the CPT ID and passcode from the settlement notice they received. Those who do not have a CPT ID and/or passcode should email AdvancedCareSettlement@cptgroup.com.
Payout options
The settlement administrator will issue payments via check by default. They may request a different payment method by contacting the settlement administrator.
$1.19 million settlement fund breakdown
The $1,190,000 settlement fund covers:
- Settlement administration costs: $12,000
- Attorneys' fees: $175,443.78
- Attorneys' expenses: $21,333.59
- Service awards to class representatives: $20,000 total ($10,000 each)
- Payments to eligible class members: The remainder of the fund

- Final fairness approval hearing: March 4, 2026
When is the Miclat v. Advanced Care Staffing payout date?
The settlement administrator will issue payments after the court grants final approval of the settlement.
Why did this class action settlement happen?
The class action lawsuit alleged that Advanced Care Staffing LLC and Priority Care Staffing LLC required health care workers to pay penalties if they left before the end of their contracts, which the plaintiffs claimed was unlawful.
The companies denied wrongdoing but agreed to settle to avoid further litigation costs and risks. The settlement also resolves related investigations by the New York Attorney General and U.S. Department of Labor.
